<br />Construction Contracts are complying with the terms of the Construction <br />Contracts and if they are not, then recommend to the parties what action <br />should be taken in order to obtain compliance. <br />2.05. To perform any and all other acts reasonable or appropriate in <br />order to complete construction of the Sanitary Sewer Interceptor in <br />accordance with the plans and specifications prepared by Byrn. <br />2.06. Notwithstanding the above, River Ridge's obligations hereunder <br />shall not imply that River Ridge is responsible for the means and method <br />of construction, including safety precautions, which matters shall be the <br />sole responsibility of the contractor or contractors engaged pursuant to <br />this Agreement. However, River Ridge shall promptly commence and <br />diligently pursue the performance of any and all actions and obligations <br />required of River Ridge pursuant to this Agreement. <br />In consideration of the performance of its duties and obligations as <br />Project Manager pursuant to this Agreement, River Ridge shall receive a project <br />management fee in an amount equal to five percent (5%) of the total cost of the <br />Project. Such project management fee shall be payable upon the acceptance of <br />the completed Sanitary Sewer Interceptor by the City. <br />Article 3. Obligations and Agreements of City. <br /> <br />3.01. The City hereby agrees to review and, if in accordance with <br />applicable City specifications and standards, to approve the plans and <br />specifications for the Sanitary Sewer Interceptor in a timely and <br />expeditious manner and, upon completion of the Sanitary Sewer Interceptor <br />in accordance with the approved plans and specifications, to accept for <br />City ownership, operation and maintenance, the completed Sanitary Sewer <br />Interceptor. <br />3.02. The City further agrees that the City will provide use of any and <br />all City rights-of-way and easements that may be reasonably necessary to <br />construct the Sanitary Sewer Interceptor or. for the Project Manager to <br />perform its obligations as provided in this Agreement. <br />3.03. The City agrees that upon completion of the Sanitary Sewer <br />Interceptor, the City will make available to each party and to their <br />respective properties that sewer capacity as stated in Exhibit D attached <br />hereto, provided that the applicable party takes the appropriate <br />procedures and actions and pays to the City the standard tap fees <br />necessary to receive such sewer capacity. <br />3.04. The City agrees that SB&K, Dobie, Salinas & Rockford, Rakor and <br />Shown shall be required to contribute to the cost of constructing the <br />Sanitary Sewer Interceptor only those amounts set forth on Exhibit C <br /> 3 <br />15/1026/3 <br />
