-12- ARTICI.E 11 INSURANCE 11.1.1 The CONSULTANT agrees to procure and maintain at its expense until final payment by OWNER for services covered by this AGREEMENT, insurance in the kinds and amounts hereinafter provided with insurance companies authorized to do business in the State of Texas, cover ing all operations under this AGREEMENT, whether performed by it or its agents, employee s, contractors or subcontractors. Before commencing the Work, CONSULTANT shall furnish to OWNER certificates in form satisfactory to OWNER, showing that CONSULTANT has complied with this Paragraph. All certificates shall provide that the policy or pol ic ie s shall not be changed or cancelled until at least thirty (30) days' written notice shall have been given to OWNER. Kinds and amounts of insurance required are as follows: Workmen's Compensation Insurance: Workmen's Compensation Insurance for its employees in accordance with the provisions of the Workmen's Compensation Act of the State of Texas. Comprehensive General Liability Insurance: Comprehensive General Liability Insurance with minimum limits of liability of not less than $500,000 aggregate for bodily inj ury, personal injury, sickness, disease or death. Broad Form property Damage Insurance: Broad Form property Damage Insurance and removal of XCU exclusions where applicable, as determined by OWNER, with minimum limits of liability of not less than $500,000 aggregate for injury to or destruction of tangible personal property of others, including loss of use thereof. CONSULTANT shall maintain Comprehensive General Liability Insurance, and Broad Form Property Damage Insurance coverages for as long as said or similar types of coverages are reasonably available and in such forms as to provide coverage for lawful claims arising before or after completion of this PROJECT and as a result of this PROJECT. Vehicle Insurance: Vehicle Insurance with minimum limits of liability of not less than $350,000 each occurrence for bodily injury and property damage combined to afford protection from claims arising out of the maintenance, operation, or use of any owned, non-owned or hired vehicles. Insurance carriers insuring CONSULTANT, its agent, employees, contractors and subcontractors, in accordance with this AGREEMENT which are not rated by the most recent edition of Best's Key Rating Guide, property-Casualty, published by A.M. Best Company, or insurance carriers having a rating lower than B+XV as shown in the most recent edition of said book, will not be approved by OWNER unless a guaranty bonct(s) acceptable to OWNER from a carrier(s) rated B+XV or higher guaranteeing payment of any and all claims against CONSULTANT, its agents, employees, contractors and subcontractors, is furnished to OWNER.
