<br /> WHEREAS, an on-site public hearing has not been requested in
<br /> writing by more than 20 adults residing in said area: and,
<br /> WHEREAS, notices of said public hearings were published in the
<br /> San Marcos Daily Record, a newspaper having general circulation in
<br /> said City and in the territory proposed for annexation, on April 27,
<br /> 1986 , and April 29,1986, said dates being not more than twenty
<br /> (20) days nor less than ten (10) days prior to the hearings for
<br /> ~mich notices were given: and,
<br /> vVHEREAS, prior to the publication of notices of said hearings,
<br /> the City Ca..mcil of the City of San Marcos, Texas, directed preparation
<br /> of a service plan that provides for the extension of municipal services
<br /> to said area proposed for annexation: and,
<br /> WHEREAS, said proposed service plan was made available for
<br /> inspection and explained to the inhabitants of the area to be annexed
<br /> at said public hearings: and,
<br /> WHEREAS, said 28.45 acres are contiguous and adjacent to
<br /> the current boundaries of the City of San Marcos, Texas; now,
<br /> therefore,
<br /> BE IT ORDAINED BY THE CITI COUNCIL OF '!HE CITI OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the following described property, being
<br /> 28.45 acres of land adjoining the existing city limits of the
<br /> City of San Marcos, Texas, out of the R.H. Williams Survey - Abstract
<br /> No. 470 and the T.J. Chambers Survey - Abstract No. 2, Hays County,
<br /> Texas, being a 27.38 acre portion of a called 43.11 acre tract and a
<br /> 1.07 acre portion of a called 1.81 acre tract described as Tract 1
<br /> and Tract 2, respectively, in a deed to Indian Creek Joint Venture as
<br /> recorded in Volume 585, Page 868 of the [ßed Records of Hays
<br /> County, 'Iexas, and being ITDre particularly described by metes and
<br /> bounds as follows:
<br /> COMMENCING for reference at a 1/2-inch iron rod in concrete at a
<br /> fence corner post for the most northerly corner of said 43.11
<br /> acre tract, said iron roo also being the southwest corner of a
<br /> 26.468 acre tract of land described in a deed to Sunridge Joint
<br /> Venture as recorded in Volume 482, Page 851 and in the southeast
<br /> line of a 322.33 acre tract of land described in a deed to
<br /> Marion H. wills, Minnie Mae wills Howard and Marvin C. Wills as
<br /> recorded in Volume 274, Page 540, both of the Hays County Ceed
<br /> Records:
<br /> THENCE along a fence \.¡ith the northwest line of said 43.11 acre
<br /> tract, same being the southeast line of said 322.33 acre tract,
<br /> the following three (3) courses and distances:
<br /> 1. S 44°561 19" W, a distance of 174.88 feet to a fence post,
<br /> 2. S 45°041 05" W, a distance of 158.95 feet to a fence post,
<br /> and
<br /> 3. S 45° 111 03"\\1, a distance of 101.50 feet to a point in the
<br /> present Corporate City Limi t Line of The City of San
<br /> Marcos, Texas according to City Ordinance 1970-9 for the
<br /> northwest corner of the herein described tract and the
<br /> mINT OF BEGINNING:
<br /> THENCE leaving said line and crossing said 43.11 acre tract with
<br /> said City Limit Line, S 45' 00 I 00" E, a distance of 2017.80 feet
<br /> to a point in the southeast line of said 43.11 acre tract, same
<br /> being a northwest line of the remainder of a 232.1 acre tract of
<br /> land as described in a deed to Mil ton Daniel Buie Properties
<br /> Partnership as recorded in Volwœ 399, Page 326 of the Hays
<br /> County Dged Records for the most northerly east corner of the
<br /> herein described tract;
<br /> THENCE leaving said City Limit Line with the common line of said
<br /> 43.11 acre tract and said Buie tract, S 02 CSll 44" E, a distance
<br /> of 414.24 feet to a l/2-inch iron roo in the north line of said
<br /> 1.81 acre tract for the southeast comer of said 43.11 acre
