43 Regular Meeting May 19, 1986 Page 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, &~ENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY CHANGING THE ZONING OF LOT 74 OF THIRD DIVISION, PARK ADDITION, AN ADDITION IN THE CITY OF SAN MARCOS AS SHOWN ON THE MAP OR PLAT THERE- OF RECORDED IN VOLUME 56, PAGE 47, HAYS COUNTY DEED RECORDS, A/KIA llli N. L.B.J. DRIVE, FROM "R-llI (SINGLE-FAMILY DWELLING DISTRICT) TO IIMF-411 (MULTI- FAMILY DISTRICT); AND DECLARING AN EFFECTIVE DATE. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY ATTORNEY TO PUR- SUE UNPAID CLAIMS OF THE CITY BY FILING PROOFS OF CLAIM IN PENDING BANKRUPTCY PROCEEDINGS AND/OR TAKING ALL OTHER ACTION NECESSARY TO THE PURSUIT AND/OR LITI- GATION OF SAID CLAIMS BY THE CITY ATTORNEY'S OFFICE, AND DECLARING AN EFFECTIVE DATE. Mr. Coddington moved for adoption of the Resolution and Ms. Kissler se- conded the motion. On roll call the following vote was recorded: AYE: Brown, Coddington, Farr, Guerra, Kissler, Nicola. NAY: Younger. ABSTAIN: None. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXE- CUTE CHANGE ORDERS WHICH WILL NOT RESULT IN AN INCREASE OF THE ORIGINAL CONTRACT AMOUNT BY MORE THAN $5,000.00 FOR ALL CONTRACTS WHICH HAVE BEEN COMPETITIVELY BID, PROVIDING FOR OTHER RESTRICTIONS AND DECLARING AN EF- FECTIVE DATE. Mr. Coddington moved for adoption of the Resolution and Mr. Guerra seconded the motion. Mr. Coddington felt this would put the City in a dangerous situation and that the Council should maintain control of all bidded items. Mr. Coddington moved to amend Part 1. to reflect the City Manager could only a~prove a single change order, not plural. There was no second to Mr. Coddington's motion. Mayor Younger moved to table the matter to be returned to the Legal Department for new wording to be placed in the Resolution which the Council might agree upon. There was no second to Mayor Younger's motion. Mr. Farr moved to amend the Resolution in Part 1. in the second line to add" . . . Change Orders which will not result in an aggregate increase of the original contract . . ., II and Mr. Nicola seconded the motion. On roll call of Mr. Farris amendment, the following vote was recorded: AYE: Brown, Farr, Guerra, Kissler, Nicola. NAY: Coddington, Younger. ABSTl'_IN: None.
