L.B.J. DRIVE, FROM "R-llI <br /> (SINGLE-FAMILY DWELLING DISTRICT) TO IIMF-411 (MULTI- <br /> FAMILY DISTRICT); AND DECLARING AN EFFECTIVE DATE. <br /> Mayor Younger introduced for consideration adoption of a Resolution, <br /> the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE CITY ATTORNEY TO PUR- <br /> SUE UNPAID CLAIMS OF THE CITY BY FILING PROOFS OF <br /> CLAIM IN PENDING BANKRUPTCY PROCEEDINGS AND/OR TAKING <br /> ALL OTHER ACTION NECESSARY TO THE PURSUIT AND/OR LITI- <br /> GATION OF SAID CLAIMS BY THE CITY ATTORNEY'S OFFICE, <br /> AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Coddington moved for adoption of the Resolution and Ms. Kissler se- <br /> conded the motion. On roll call the following vote was recorded: <br /> AYE: Brown, Coddington, Farr, Guerra, Kissler, Nicola. <br /> NAY: Younger. <br /> ABSTAIN: None. <br /> Mayor Younger introduced for consideration adoption of a Resolution, <br /> the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXE- <br /> CUTE CHANGE ORDERS WHICH WILL NOT RESULT IN AN INCREASE <br /> OF THE ORIGINAL CONTRACT AMOUNT BY MORE THAN $5,000.00 <br /> FOR ALL CONTRACTS WHICH HAVE BEEN COMPETITIVELY BID, <br /> PROVIDING FOR OTHER RESTRICTIONS AND DECLARING AN EF- <br /> FECTIVE DATE. <br /> Mr. Coddington moved for adoption of the Resolution and Mr. Guerra <br /> seconded the motion. Mr. Coddington felt this would put the City in <br /> a dangerous situation and that the Council should maintain control <br /> of all bidded items. Mr. Coddington moved to amend Part 1. to reflect <br /> the City Manager could only a~prove a single change order, not plural. <br /> There was no second to Mr. Coddington's motion. Mayor Younger moved <br /> to table the matter to be returned to the Legal Department for new <br /> wording to be placed in the Resolution which the Council might agree <br /> upon. There was no second to Mayor Younger's motion. Mr. Farr moved <br /> to amend the Resolution in Part 1. in the second line to add" . . . <br /> Change Orders which will not result in an aggregate increase of the <br /> original contract . . ., II and Mr. Nicola seconded the motion. On roll <br /> call of Mr. Farris amendment, the following vote was recorded: <br /> AYE: Brown, Farr, Guerra, Kissler, Nicola. <br /> NAY: Coddington, Younger. <br /> ABSTl'_IN: None. <br />
