100 ORDINANCE 1986-61 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-2.1 OF THE CODE OF ORDINANCES OF SAID CITY PROVIDING FOR NEW LIMITS ON THE AUTHORITY OF THE CITY MANAGER TO CONTRACT FOR BUDGETED EXPENDITURES, REGULATING SUCH CONTRACTS, RENUMBERING SAID SECTION AS 2-9, AND, DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2-2.1 of the Code of Ordinances is hereby repealed and the following provisions substituted therefor as Section 2-9 of the Code of Ordinances: Sec. 2-9. Authority of city manager to contract for expenditures not exceeding five thousand dollars. (a) The city manager of the City is hereby authorized and shall henceforth have general authority to contract on behalf of said City for expenditures without further Council approval for all budgeted items not exceeding five thousand dollars ($5,000.00). (b) Said contracts and agreements entered into by said city manager on behalf of said City shall be subject to approval by the city attorney. (c) Any contract entered into in violation of subsections (a) or (b) above shall be void and shall not be recognized by any city official or employee for any purpose, including the payment of statements rendered pursuant thereto. SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
