<br />100 <br />ORDINANCE 1986-61 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 2-2.1 <br />OF THE CODE OF ORDINANCES OF SAID CITY <br />PROVIDING FOR NEW LIMITS ON THE AUTHORITY OF <br />THE CITY MANAGER TO CONTRACT FOR BUDGETED <br />EXPENDITURES, REGULATING SUCH CONTRACTS, <br />RENUMBERING SAID SECTION AS 2-9, AND, <br />DECLARING AN EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 2-2.1 of the Code of Ordinances <br />is hereby repealed and the following provisions substituted <br />therefor as Section 2-9 of the Code of Ordinances: <br /> <br />Sec. 2-9. Authority of city manager to contract for <br />expenditures not exceeding five thousand <br />dollars. <br /> <br />(a) The city manager of the City is hereby <br />authorized and shall henceforth have general authority <br />to contract on behalf of said City for expenditures <br />without further Council approval for all budgeted items <br />not exceeding five thousand dollars ($5,000.00). <br /> <br />(b) Said contracts and agreements entered into by <br />said city manager on behalf of said City shall be <br />subject to approval by the city attorney. <br /> <br />(c) Any contract entered into in violation of <br />subsections (a) or (b) above shall be void and shall not <br />be recognized by any city official or employee for any <br />purpose, including the payment of statements rendered <br />pursuant thereto. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten <br />(10) days from and after its passage, and it shall be published in <br />a newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading May 12, 1986. <br /> <br />PASSED AND APPROVED on second reading May 19, 1986. <br /> <br />PASSED, APPROVED D ADOPTED June 9, 1986. <br /> <br />), <br /> <br />~ <br /> <br />.E.
