Pub1\c Law 93-234, <br /> 81 Stat. 915. approved December 31, '916. Sect\on 102(a) reQu1res, on <br /> and after March 2.1915, the purchase of flood \nsurance 1n commun\t1es <br /> where such \nsurance 1s ava11ab1e as a cond\t\on for the rece\pt of any <br /> Federal f\nanc1a1 ass1stance for construct'on or acQu\s\t\on purposes <br /> for use \n any area that has been 1dent1fied by the Secretary of the <br /> Department of Housing and Urban Development as an area hav1ng spec\a1 <br /> flood hazards. The phrase -Federal financ1a1 ass1stance" 1nc1udes any <br /> form of loan, grant, guaranty, 1nsurance payment, rebate. subs1dy, <br /> d1saster ass1stance loan or grant. or any other form of d1rect or <br /> 1nd1rect Federal ass1stance. <br /> 19. It w111 ass1st the Federal grantor agency 1n 1ts comp11ance w1th Sect10n <br /> 106 of the National Histor1c Preservation Act of '966 as amended (16 <br /> U.S.C. 410). Execut1ve Order 11593, and the Archeo1og1ca1 and Historic <br /> Preservat\on Act of 1966 (16 U.S.C. 469a-l et seQ.) by (a) consulting <br /> with the state H1stor\c Preservat10n Off1cer on the conduct of <br /> investigat1ons. as necessary, to identify propert1es 11sted in or <br /> e1\gib1e for 1nc1us\on in the National Register of H\stor\c Places that <br /> are subject to adverse effects (see 36 CFR Part 800.8) by the activ\ty. <br /> and notify\ng the Federal grantor agency of the ex\stence of any such <br /> propert\es, and by (b) complying with all requirements estab11shed by <br /> the Federal grantor agency to avo\d or m1tigate adverse effects upon <br /> such propert1es. <br /> 20. (a) -It w1ll comply with Texas C1v11 statutes, Art1cle 599ba, by <br /> \nsuring that no officer, employee, or member of the app11cant's <br /> govern\ng body or of the app11cant's contractor shall vote or confirm <br /> the employment of any person related with1n the second degree by <br /> aff1n1ty or th1rd degree by consangu\nity to any member of the govern1ng <br /> body or to any other off1cer or employee authorized to employ or <br /> superv1se such person. Th\s proh\b\tion shall not prohibit the <br /> employment of a person who shall have been continuously employed for a <br /> period of two years prior to the e1ect10n or appointment of the off1cer. <br /> employee. or governing body member related to such person in the <br /> prohibited degree.- <br /> (b) -It w111 \nsure that all information collected, assembled or <br /> maintained by the applicant relative to this project shall be ava11able <br /> to the public dur1ng normal bus\ness hours \n comp11ance with Texas <br /> Civil Statutes. Article 6252-11a, unless otherw1se expressly prov1ded by <br /> law. - <br /> (c) -It w111 comply w\th Texas C\v\l Statues, Art\c1e 6252-17, which <br /> requires all regular, spec1al, or called meet1ngs of governmental bodies <br /> to be open to the pub11c. except as otherw\se prov1ded by law or <br /> spec1f1ca1ly perm1tted 1n the Texas Constitut10n." <br /> 5 <br />
