Second Party agrees to <br /> sue for recovery of the costs as court costs as provided by Texas <br /> Property Tax Code Section 33.48 (Vernon 1979). It is understood and <br /> ag reed tha t First Party shall not be liable for any of such costs <br /> referred to hereinabove; however, subject to First Party's prior <br /> approval, First Party shall be liable for expenses incurred in citing <br /> defendants by publication and shall pay the newspaper(s) making such <br /> publication(s) as soon as practicable following receipt of the <br /> publisher's claim for payment. <br /> Second Part y agrees to make progress reports to First Party on <br /> request, and to advise First Party of all cases where investigation <br /> reveals taxpayers to be financially unable to pay their delinquent <br /> taxes. <br /> VI. <br /> First Party agrees to pay to Second Party as compensation for <br /> services required hereunder fifteen percen~ 15 %) of the amount <br /> collected of all delinquent taxes, penalty and interest of the years <br /> covered by this Contract which are subject to the terms hereof as <br /> provided in Article I hereinabove, actually collected and paid to the <br /> collector of taxes during the term of this Contract. All compensation <br /> above provided for shall be paid by First Party to Second Party <br /> monthly. <br /> VII. <br /> This Contract shall be in full force and effect for a period of <br /> two (2) years beginning June 12, 1986, and ending June 11, 1988. First <br /> Party shall have the option, exercisable at any time that this Contract <br /> is in force, to renew and extend the same on its identical terms for an <br /> additional two-year period commencing June 12, 1988. On termination of <br /> this Contract, Second Party shall have an additional six months after <br /> termination to reduce to judgment all suits filed prior to the date of <br /> termination, and provided further that Second Party shall handle to <br /> conclusion all suits in which trial court judgments are obtained during <br /> the period of this Contract and which are appealed by any party. In <br /> consideration of the terms and compensation hereinstated, Second Party <br /> hereby accepts said employment and undertakes the performance of this <br /> Contract as above written. Either party shall have the right to sooner <br /> -2- <br />
