104 RESOLUTION 1986-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REDUCING ITS EXTRATERRITORIAL JURISDICTION IN THE AREA OF IH-35 NORTH AND YARRINGTON ROAD, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, and the City of Kyie, Texas, have overlapping extraterritorial jurisdlctions ln the vicinity of IH-35 North and Yarrington Road: and, WHEREAS, tne City of San Marcos has exclusive jurisdiction over approximately one-half of a proposed subdivision cailed Champions Business Park, the plat of which has been approved by the City of Kyle: and, WHEREAS, Article 970a, Section 3. C., Municipal Annexation, V.A.T.S., provides that II [t]he extraterritorial j urisdictl0n of a city shal i not be reduced without the written consent of the governing body of such city... II now, therefore, : BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the extraterritorial jurisdiction of said City is hereby reduced so as to no longer inciude therein that area hlghlighted ln red on Exhibit A, which is attached hereto and incorporated herein for all purposes, presently located within said City.s extraterritorial jurisdiction oy virtue of annexation ordinance no. 1983-42, same being a portion of a 59.90 acre tract of land out of the William Ward Survey No. 3, Hays County, Texas, and oeing that tract of land as conveyed oy deed recorded ln Volume 431, Page 634, Real property Records of Hays County, Texas, and the same shall not be incl uded within said City.s extraterritorial jurisdiction until further action of the City Council of the City of San Marcos.
