<br />MARCOS, TEXAS, AlI1ENDING SECTION 3 OF THAT ORDINANCE vTHICH
<br />RffiULATES AND RESTRICTS THE LOCATION AND USE OF BUIlDINGS,
<br />STRUC'IURES A!\TD LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />CHANGING THE ZONING OF A 17,327 SQUARE FOOT TRACT Of
<br />LAND, BEING THE I\DRTffiilEST PART OF lilT 26 AND 11m 3)U1HEAST
<br />PART OF LOT 25, FOREST HILL ADDITION, BLOCK ONE, 4TH
<br />REVISION, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS,
<br />SAID HAP OR PLAT BEU1G RECORDED IN VOLUME 151, PAGE 23,
<br />HAYS COUNTY DEED RECDRDS, A/K/A 804 N. L.B.J. DRIVE
<br />FROM IIR-l" (SINGLE';-FAl'lILY DVJELLING DISTRICT) 10 "C"
<br />(COMMERCIAL DISTRICT): AND DECLARING AN EFFECTIVE DATE.

<br />\\lHEREAS, on April 1, 1986, the Zoning commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "R-l" (Single-Family welling District) to IIC" (Cornrœrcial
<br />District) of a 17,327 square foot tract of land out of the Forest
<br />Hill Addition, a subdivision in said City: and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on April 1,1986, consider said request and
<br />voted to approve the same and has recomrænded that such request be
<br />approved by the City Council of said City: and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 23 day
<br />of June , 1986, regarding such request: and,
<br />
<br />v-JHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met: and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety: now, therefore,
<br />
<br />BE IT ORDAINED BY 'IRE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />IIR-ll1 (Single-Family welling District) henceforth shall be rezoned "CII
<br />(Cbmrærcial District):

<br />17,327 SQUARE FOOT TRACT OF LAND BEING 'IRE NORTHWEST PART OF LOT
<br />26 AND 'IRE SJU'IREAST PART OF LOT 25 FOREST HILL ADDITION, BlOCK
<br />ONE, 4'IR REVISION.
<br />
<br />Beginning at a concrete monument on the east line of L B J Drive
<br />(formerly North Austin Street) and on the west line of a tract
<br />of land conveyed by Ella D. Lowery, a widow, to R.L. Lightfoot,
<br />by deed of date July 15,1947, and of record in Volume 140,
<br />pages 160-163, of the Deed Records of Hays County, Texas, and on
<br />the west line of Lot 25, Block One (1) of Forest Hill Addition,
<br />4th Revision, as of record in Volume 151, Page 23, of the Hays
<br />County Deed Records: and the beginning corner is the most
<br />western corner of the tract of land hereby conveyed and fran
<br />which point aLive Oak tree, 12 inches in diameter, marked X,
<br />bears N. 30 0 38' E. 25.3 feet and an Elm, 6 inches in
<br />diameter, marked X, bears N. 75 47' E. 28.1 feet, and a concrete
<br />monument at a salient corner of the original tract of land bears
<br />N. 9 057' W. 291.29 feet:

<br />THENCE with the east line of L B J Drive and the west line of
<br />Lot 25 and Lot 26, S. 957' E. 138.67 feet to an iron pipe on
<br />the North side of a rock wall, for the most southern corner;

<br />'IRENCE with the north side of the rock wall, N. 44 42' E. 182.67
<br />feet to an iron pipe on the west line of a 25-foot alley and on
<br />the east line of Lot 26 for the most eastern corner:

<br />Lot 26 and Lot 25, N. 17 09' W. 97.01 feet to an iron stake for
<br />most northern corner:
