<br /> 18 <br /> ORDINANCE 1986-66 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br /> RffiULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br /> S'IRUC'IURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY <br /> CHANGING THE ZONING OF 0.37 ACRES OF LAND IN SAN <br /> MARCOS, HAYS COUNTY, TEXAS, BEING THAT SAME 'IRACT AS IS <br /> OCCUPI ED ON THE GROUND AND CONVEYED 10 COMANŒE STREET <br /> PARTNERS BY DEED OF RECORD IN VOLUME 408, PAGE 231, HAYS <br /> COUNTY DEED RECORDS, LOCATED AT 420 NORTH S'IREET, FROM <br /> IIM-4" (MULTI-FAMILY DIS'IRICT) 10 II MF-5 " (MULTI-FAMILY <br /> DISTRICT); AND DECLARING AN EFFff:TIVE DATE. <br /> WH EREAS, on May 6,1986, the Zoning Commission of the City of <br /> San Marcos held a public hearing regarding a request to change the <br /> zoning from IIMF-411 (Multi-Family District) to "MF-5" (Multi-Family <br /> District) of 0.37 acres of land in said City: and, <br /> WHEREAS, subsequent to said public hearing on said da te, said <br /> Comrni ss ion did, on May 6,1986, consider said request and <br /> voted to approve the same and has recormœnded that such request be <br /> approved by the City Council of said Ci ty : and, <br /> ~\lHEREAS, said City Council held a public hearing on the 23 day <br /> of June ,1986, regarding such request: and, <br /> WHEREAS, all requirerœnts of Appendix A, General Zoning <br /> Ordinance, of the Code of Ordinances of the City of San Marcos <br /> pertaining to amendments have been met: and, <br /> WHEREAS, said City Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the public <br /> health, morals, welfare and safety: now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1. That the following described tract of real property <br /> loca ted in San Marcos, Hays County, Texas, which is presently zoned <br /> IIMF-4" (Multi-Family District) henceforth shall be rezoned IIMF-5" <br /> (Multi-Family District): <br /> FIELD NOTES FOR 0.37 ACRES OF LAND IN SAN MARCOS, TEXAS, SAID <br /> 0.37 ACRES BEING THAT SAME TRACT AS OCCUPIED ON THE GROUND, <br /> CONVEYED 10 COMANCHE STREET PARTNERS BY DEED OF RECORD IN <br /> VOLUME 408 AT PAGE 231, DEED RECORDS, HAYS COUNTY, TEXAS, SAID <br /> 0.37 ACRES BEING MORE PARTICULARLY DESCRIBED BY METES AND roUNDS <br /> AS FOLLa'¡¡S: <br /> Beg inning for reference at an iron rod found at the northwest <br /> corner of that certain tract of land conveyed to the First <br /> Baptist Church of San Marcos by deed of record in Volume 284 at <br /> Pa;:}e 340, Deed Records Hays County, Texas, said point being on <br /> the east R.O.W. line of North Street, <br /> THENCE, with the east R.O.W. line of said North Street, N 8 o <br /> 00'00" W 243.36 feet to a 1/2" diameter iron rod found at the <br /> northwest corner of that certain 0.65 acre tract conveyed to <br /> Meadomrook Apartments Limited by deed of record in Volume 344 <br /> at Pa;:}e 843, Deed Records, Hays County, Texas, said point being <br /> the southwest corner and the mINT OF BffiINNING HEREDF: <br /> THENCE, with the east R.O.W. line of said North Street, N 8° 00' <br /> 00" W 108.82 feet to a 1/2" diameter drill hole set at the east <br /> edge of an exis ting concret sidewalk, said point being at the <br /> intersection of the south R.O.W. line of Lindsey Street and the <br /> east R.O.W. line of North Street, said point being the northwest <br /> comer hereof; <br /> THENCE, with the south R.O.W. line of lindsey Street, N 75 ° <br /> 39'35" E 142.10 feet to an IIX" cut on a concrete retaining wall, <br /> said point being the northwest corner of that certai tract <br /> conveyed to Kennth O.
