<br />29 <br /> <br />ORDINANCE 1986-68 <br /> <br />"\ <br />,~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING APPENDIX C, <br />SUBDIVISIONS OF THE SAN MARCOS CODE OF <br />ORDINANCES BY ADDING TO ARTICLE V, SECTION F, <br />SUBSECTION 16 TO PROVIDE FOR ADMINISTRATIVE <br />APPROVAL OF PLANNED UNIT DEVELOPMENT DISTRICT <br />DESIGN CHANGES, AND DECLARING AN EMERGENCY. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That, Article V, Section F, Subsection 16 of <br />Appendix C of the San Marcos Code of Ordinances is repealed. <br /> <br />SECTION 2. That a new Article V, Section F, Subsection 16 <br />of Appendix C of the San Marcos Code of Ordinances is approved to <br />read as follows: <br /> <br />16. Effects of recording development plan: <br /> <br />a. All final development plans registered and <br />recorded in compliance with Section F shall be <br />binding on the applicants, their successors <br />and assignees, and shall limit and control the <br />issuance and validity of all permits and shall <br />restrict and limit the construction, location, <br />use and operation of all land and structures <br />included within the plans to all conditions <br />and limitations set forth in them except for <br />changes made in compliance with subsection 16, <br />part b below. <br /> <br />b. The Director of Planning may approve the <br />following changes administratively as long as <br />the change does not change the use of a <br />structure or site, so long as the change does <br />not exceed the maximum allowed coverage for <br />the lot, and so long as the change does not <br />violate setback requirements or any other <br />provisions of the San Marcos Code of <br />Ordinances: <br /> <br />1. The reasonable relocation of any <br />building, parking lot, or other <br />constructed facility within a specific <br />legal lot when the relocation does not <br />change the size or design integrity of <br />the relocated facility; <br /> <br />2. The addition of up to 10% more building <br />area or parking area on a legal lot: <br /> <br />3. The addition of building coverage up to a <br />maximum of 50% of the specific legal lot: <br /> <br />4. A change in height of any building up to <br />an additional floor; <br /> <br />5. The substitution of structured parking <br />for grade parking on a specific legal <br />lot, not to exceed the originally planned <br />impervious cover for that specific lot: <br /> <br />6. The substitution of materials within a <br />family (e.g., masonry, brick, stone, <br />precast concrete, GFRC, stucco, etc.) for <br />building exteriors and site <br />pavingjhardscape: <br /> <br />7. The redesign of drainage within the <br />entire site or on an individual lot if <br />designed by a registered engineer and <br />approved by the San Marcos department of <br />Engineering: <br />
