<br /> 40 <br /> ORDINANCE 1986-71 <br /> AN ORDINANCE OF THE CITY COUNCIL OF 'rHE CITY <br /> OF SAN MARCOS, TEXAS, EXTENDING THAT FRANCHISE <br /> AGREEMENT OF FEBRUARY 20, 1951 BETWEEN SAID <br /> CITY AND THE SAN MARCOS TELEPHONE COMPANY FOR <br /> A PERIOD OF SIXTY (60) DAYS, AND DECLARING AN <br /> EMERGENCY. <br /> WHEREAS, that franchise agreement between the City of San <br /> Marcos, Texas, and the San Marcos Telephone Company of February <br /> 20, 1951 will expire August 19, 1986: and, <br /> WHEREAS, negotiations between the parties have not yet been <br /> completed regarding the terms of a subsequent franchise agreement <br /> under which said Telephone Company may operate in the City of San <br /> Marcos, Texas: and, <br /> WHEREAS, it is the intention of said parties that said <br /> franchise agreement not expire on August 19, 1986; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the terms and conditions of that <br /> franchise agreement of February 20, 1951 between said City and the <br /> San Marcos Telephone Company, a copy of which is attached hereto <br /> and incorporated herein for all purposes, are hereby extended. <br /> SECTION 2. That the extension of said franchise agreement <br /> shall be for a term of sixty (60) days from the date of expiration <br /> of said franchise agreement, and Section 1 of said frandhise <br /> agreement of February 20, 1951 is hereby amended to such extent. <br /> SECTION 3. That the importance of this Ordinance creates <br /> an emergency and an imperative public necessity so that the <br /> provisions of the Charter requiring that ordinances shall be <br /> presented at three separate meetings and that no ordinance shall <br /> become effective until the expiration of ten (10) days following <br /> the d.ate of its final passage be suspended, and these provisions <br /> are hereby suspended, and this Ordinance shall take effect and be <br /> in full force and effect from and after its adoption and after its <br /> publication in a newspaper of general circulation in the area as <br /> required by the Charter of the City of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 7 day of July , <br /> 1986. <br /> Attest: <br /> r:1 ~~ gr~~ <br /> Janis K.
