<br /> Electric Power Agreement -3- <br /> the point of connection between the City's facilities and the <br /> facilities of the LCRA. The City will set a reasonable wheeling <br /> or facilities use charge for the use of City facilities. <br /> 2.05. The university will provide, through its Continuing <br /> Education Program, professional training in subjects useful to the <br /> staff of the City's electric system. <br /> 2.06. None of the utility's retail customers will be subject <br /> to arbitrary rate increases contrary to public interest. <br /> 2.07. The utility will not increase Sì"1T' s electric rates by <br /> a percentage greater than the highest percentage increase for all <br /> other classifications of the utility's retail customers. <br /> Additionally, the utility shall base any increase of SWT's <br /> electric rates on a current cost of service analysis. <br /> 3. TERM <br /> 3.01. This agreement will begin on the date the City begins <br /> selling electricity on a retail basis to SWT. It shall continue <br /> in effect as long as the City continues to sell electricity to any <br /> retail customers. However, either party may terminate this <br /> agreement after giving the other one year's written notice. <br /> 4. GENERAL PROVISIONS <br /> 4.01. This agreement constitutes the entire agreement of the <br /> parties and supersedes any prior understandings or written or oral <br /> agreements respecting these matters. <br /> 4.02. Neither party may assign any of its duties under this <br /> agreement without the written consent of the other. <br /> 4.03. This agreement shall be construed under the laws of <br />
