<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CIr( OF SAN
<br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATI~~ AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOT 44 OF THE SOUTHEND ADDITION TO
<br /> THE CITY OF SAN MARCOS, TEXAS, A SUBDIVISION IN THE CITY
<br /> OF SAN MARCOS AS SHOWN ON THE MAP OR PLAT THEREOF
<br /> RECORDED IN VOLUME 55, PAGE 601, OF THE HAYS COUNTY DEED
<br /> RECORDS; A/K/A 701 ALABAt1A STREET FRON "1'1" (SINGLE, DUPLEX
<br /> AND NEIGHBORHOOD BUSINESSES DISTRICT) TO "R-!" (SINGLE
<br /> FAMILY DWELLING, DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on June 3, 1986, the Zoning Co~~ission of the City of
<br /> San Marcos held a publ ic hearing regarding a request to change the
<br /> zon i ng from "1'1" (Single, Duplex and Neighborhood Businesses District)
<br /> to "R-!" (Single Family Dwell ing District) of Lot 44 of the
<br /> Southend Addition, San Marcos, Hays County, Texas; and,
<br /> WHEREAS, subsequent to said publ ic hearing on said date, said
<br /> Commission did, on June 3, 1986, consider said request and
<br /> voted to approve the same and has recommended that such request be
<br /> approved by the Ci ty Council of said Ci ty; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 14 day
<br /> of July , 1986, regarding such request; and,
<br /> WHEREAS, all requirements of Appendix A, General Z on i n g
<br /> Ordinance, of the Code of Ordi nances of the Ci ty of San tiarcos
<br /> pertaining to amendments have been met; and,
<br /> l.. HEREAS, said Ci ty Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the pub1 ic
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS; fEXAS:
<br /> SECTION 1. That the following described tract of real property
<br /> located in San Marcos, Hays County, Te){as, which is presently zoned
<br /> "1'1" (Single, Duplex and Neighborhood District) henceforth shall be
<br /> rezoned "R-1" (Single Family Dwelling District):
<br /> LOT 44 OF THE SOUTHEND ADDITION TO THE CITY OF SAN i'1ARCOS,
<br /> TEXAS, A SUBDIVISION IN THE CITY OF SAN t1ARCOS AS S H Ol.oJN ON
<br /> THE MAP OR PLAT THEREOF RECORDED IN VOLUME 55, PAGE 601, OF
<br /> THE HAYS COUNTY DEED RECORDS.
<br /> SECn ON 2. That this Ordinance shall be in effect ten (10) days
<br /> from and after its passage and after it hac- been subjec t to
<br /> recons i dera t i on by the Council at its next regular meeting following
<br /> its passage, and providing that the Council did not vote to reconsider
<br /> .... If reconsidered on July 28, 1986 it shall be in effect ten
<br /> I ~. days from and after its passage on that date if approved. It sha 11 not
<br /> go into effect if denied. If not reconsidered or if reconsidered and
<br /> approved it shall be publ ished in a newspaper of general circulation in
<br /> the area as required by the Charter of the City of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this the 14 day of July, 1986 ,
<br /> subject to reconsideration at the next regular City Council meeting
<br /> scheduled for July 28, 1986 .
