<br />~\ AN ORDiNANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />-,1 MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LPND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />CHANGING THE ZONING OF 1.8771 ACRES OF LAND SITUATED
<br />IN A TRACT CALLED THE SECæ~D TRACT IN A CONVEYANCE FROM
<br />A.B. ROGERS AND WILL G. BARBER TO EDWIN C. WILLIS, VOLUME
<br />107, PAGE 130, DEED RECORDS, CIlr( OF SAN MARCOS, T.H.W.
<br />FORS'fTH SURVEY, HAYS COUNTY, TEXAS, LOCATED ON THE SOUTH
<br />SIDE OF THE 1700 BLOCK OF RANCH ROAD 12, FROM DR-I"
<br />(SINGLE-FAMILY DWELLING DISTRICT) TO "CD (COMMERCIAL
<br />DISTRICT); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on April 15, 1986, the Zoning Commission of the City
<br />of San Marcos held a publ ic hearing regarding a request to change
<br />the zoning from "R-l" (Single Family Dwelling District> to
<br />"c" (Commercial District> of 1.8771 acres of land in said City; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on April 15,1986, consider said request
<br />and voted to approve the same and has recomñended that such
<br />request be approved by the City Council af said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 14 day
<br />of July , 1986, regard i ng such request; and,
<br />
<br />WHEREAS, all requ i remen ts of Append i x A, General Zon i g
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, weHa::,nd safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECT! ON 1. That the fall Ql.\1 i ng descr i bed tract of ,'f~a 1 property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />DR-l" (Single Family Dwelling District> henceforth shall be
<br />rezoned "C" (Commercial District):

<br />FIELD NOTES describing 1.8771 acres of land situated in a tract
<br />called the Second Tract in a conveyance from A.B. Rogers and
<br />Will G. Barber to Edwin C. Will is, Volume 107, Page 130, deed
<br />records, City of San Marcos, T.H.W. Forsyth Survey, Hays County,
<br />Texas, and described by metes and bounds as fallows:

<br />BEGINNING at an iron pin found marking the north corner of this
<br />tract, the north corne of the called Second Tract, the east
<br />carner of a tract called 9.75 acres in a conveyance recorded in
<br />Volume 138¡ ge 364, and situated in the southwest right-of-way
<br />of Ranch Road 12;
<br />
<br />THENCE with the fenced southwest right-of-way of Ranch Road 12,
<br />S 79° 441 E 261.18 feet to an iron pin found marking the east
<br />corner of this tract;
<br />
<br />THENCE with a fence, S 18°061 28" W 20.77 feet to an iron pin
<br />found situated in the cammon 1 ine between the Forsyth Survey and
<br />the E. Clark Survey;
<br />
<br />THENCE with the fenced common line between the Forsyth Survey
<br />and the E. Clark Survey, S 46 43" W 161.32 feet to an iron
<br />pin found, S 45°021 50"W 27.26 feet to an iron pin found and S
<br />4~301 27" W 157.86 feet to a point marking the south corner of
<br />this tract;

<br />THENCE across the called Second Tract, N 79~41 W 272.96 feet to
<br />a point marking the west ner of this tract situated in the
<br />COff~on line between the called Second Tract and the called 9.75
<br />acre tract;
<br />
<br />THENCE with the fenced common 1 ine between the called Second
<br />Tract and the called 9.75 acre tract, N 46°261 42" E 371.66 feet
<br />to the PLACE OF BEGINNING and containing 1.8771 acres of land.
