<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, AMe~DING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOlS 6 AND 7 OF THE B.G. COLLIER
<br /> SUBDIVISION NEAR SAN MARCOS, HAYS COUNTY, TEXAS, A PORTION
<br /> OF THE J.M. VERAMENDI SURVEY, HAYS COUNTY, TEXAS, AS
<br /> RECORDED IN VOLUME 108, PAGE 34, OF THE HAYS COUNTY DEED
<br /> RECORDS AND 0.135 OF AN ACRE OF LAND OUT OF AND A PART OF
<br /> THE J.M. VERAMEND I LEAGUE, CITY OF SAN MARCOS, HAYS
<br /> COUNTY, TEXAS, AND LOCATED NORTH OF SPRING ROAD AND ON
<br /> POST ROAD FROM "M" (SINGLE, DUPLEX AND NEIGHBORHOOD
<br /> BUSINESSES DISTRICT> TO "MF-3" (MULTI-FAMILY DISTRICT>;
<br /> AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on May 6, 1986, the Zoning Commission of the City of
<br /> San Marcos held a publ ic hearing regarding a request to change the
<br /> zoning from "M" (Single, Dup lex, and Neighborhood Businesses
<br /> District) to "MF-5" (Mu 1 t i -Fam i 1 y District> of Lots 6 and 7 of the
<br /> B.G. CoIl ier Subdivision, San Marcos, Hays County, Texas and
<br /> 0 . 135 of an acre of 1 and out of and a part of the J.M. Veramendi
<br /> League, City of San Marcos, Texas; and,
<br /> l"¡HEREAS, subsequent to said publ ic hearing on said date, said
<br /> Commission did, on May 6, 1986, consider said request and
<br /> voted to deny the same but recommended that a zoning change to MF-3
<br /> be approved by the City Council of said City; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 14 day
<br /> of July , 1986, regarding such request; and,
<br /> WHEREAS, all requirements of Appendix A, General Z on i n 9
<br /> Ordinance, of the Code of Ordinances of the Ci ty of San ~1arcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, said Ci ty Counc i 1 hereby finds and de term i nes that the
<br /> adoption of the following ordinance is in the interest of the public
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the following described tract of real proper ty
<br /> located in San Marcos, Hays County, Texas, wh i ch i s presently zoned
<br /> "1'1" (Single, Dup lex and Neighborhood Businesses District)
<br /> henceforth shall be rezoned "MF~3" (Mutl i-Family District>:
<br /> LOlS6 AND 7 OF THE B.G. COLLIER SUBDIVISION NEAR SAN MARCOS,
<br /> HAYS COUNTY, TEXAS, A PORTION OF THE J.M. VERAMEND I SURVEY,
<br /> HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 108, PAGE 34, OF THE
<br /> HAYS COUNTY DEED RECORDS.
<br /> SECT! ON 2. That the following described trac t of real property
<br /> located in San Marcos, Hays County, Texas, which is presently zoned
<br /> "1'1" (Single, Dup lex and Neighborhood Businesses District)
<br /> henceforth shall be rezoned "MF-3" (Mutl i-Fami ly District):
<br /> Field Notes comp i led from records of 0.135 of an acre of land
<br /> out of and a part of the J.M. Veramendi League, situated in the
<br /> Ci ty of San Marcos, Texas, said 0.135 acre tract being more
<br /> particularly described as being a portion of that certain tract
<br /> of land conveyed to Leon R. ( i n g by deed of record in Vo 1 ume
<br /> 210, Page 636 of the Deed Records of Hays County, Texas, said
<br /> 0.135 acre tract being more fully described by metes and bounds
<br /> as follows:
<br /> BEGINNING at a point in the northwest 1 ine of County Road No.
<br /> 1421, at the southeast corner of Lot 7 B.G. CoIl ier Subdivision,
<br /> of record in Volume 108, Page 34 of the Deed Records of Hays
<br /> County, Texas, at the southwest corner of said ( i ng trac t for
<br /> the sou t h~'le s t corner of the t r ac t herein described;
<br /> THENCE leaving said county road and with the east 1 ine of said
<br /> Lot 7 N 52°30~ W 159.76 feet to a point at the common east
