-9- Util ity District shall be a matter of publ ic record, and available for City inspection at all time s. I. The Util ity District shall prepare for and submit to the City annual reports on the status of construct i on and bond sales. J. All bonds issued by the Util ity District shall have a call provision which allows the option to redeem the bonds at par. K. The Utility District shall not furnish water or wastewater service to any tract of hnd unless the Planning Commission of the City of San Marcos has approved a subdivision plat covering such t r ac t of land and such plat has been recorded in the deed records of the appropriate County. The Planning Commission of the City of San Marcos will not be required to approve any subdi t.1 i si on within a Util ity District which does not conform to the provisions of the consent agreement. L. The Util ity District shall not provide service outside its boundaries unless approval is obta i ned from the City Council. If such permission is gran ted, no bond funds sha 11 be expended or indebtedness incurred to provide such service without approval of the City Council. M. The City shall review and approve the adequacy, type and construction of all roadways in the Utility District. N. The City may require the construction of facilities or improvements for the purpose of mitigating the impacts of stormwater runoff. O. No land within the Util ity District shall be allowed at any time in the future, to incorporate, join in an incorporation, or be annexed into any incorporated city other than the City of San Marcos. P. No land may be annexed to or acquired by a Ut i 1 i ty District without the approval of the City Council. G. Right-of-way, publ i c park land, ut i 1 i ty and drainage easements and all other appropriate lands and easements sh a 11 be properly dedi cated to the publ i c, by the Util ity District and its ultimate successor. R. The net effective interest rate will not exceed 2% above the highest average interest rate reported by the Daily Bond Buyer in its weekly "20 Bond Index. during the one -mon t h period preceding the date notice of sale is given.
