<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, T~~S, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOTS 8, 9 AND 10 OF THE B.G.
<br /> COLLIER SUBDIVISION NEAR SAN MARCOS, HAYS COUNTY, TEXAS,
<br /> A PORTION OF THE J.M. VERAI~1ENDI SURVEY, HAYS COUNTY,
<br /> TEXAS, AS RECORDED IN VOLUME 108, PAGE 34, OF THE HAYS
<br /> COUNTY DEED RECORDS AND 0.194 OF AN ACRE OF LAND OUT OF
<br /> AND A PART OF THE J.M. VERAMENDI LEAGUE IN THE CITY OF
<br /> SAN MARCOS, HAYS COUNTY, TEXAS AND LOCATED NORTH OF
<br /> SPRING ROAD AND ON POST ROAD, FROM "M" (SINGLE, DUPLEX
<br /> AND NEIGHBORHOOD BUSINESSES DISTRICT) TO "MF-3" (MULTI-
<br /> FAMILY DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on May 6, 1986, the Zoning Commission of the City of
<br /> San Marcos held a publ it hearing regarding a request to change the
<br /> zoning from "M" (Single, Duplex, and Neighborhood Businesses
<br /> District) to "MF-3" (Mu 1 t i -Fam i 1 y District> of Lo ts 8, 9 an d 1 0
<br /> of the B.G. ColI ier Subdivision and 0.194 of an acre of land out of
<br /> and a part of the J.M. Veramendi League in the City of San Marcos, Hays
<br /> County, Texas, said parcels of land being located in the City of San
<br /> Marcos, Hays County, Texas; and,
<br /> WHEREAS, subsequent to said pub 1 ic hearing on said date, said
<br /> Commission did, on May 6, 'i':36, consider said request and
<br /> voted to approve the same and has recommended that such request be
<br /> appro!Jed by the Ci ty Counc i 1 of said Ci ty; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 14 day
<br /> of July , 1986, regarding such request; and,
<br /> 'NHEREAS, all requirements of Appendix A, General Zen i ng
<br /> Ordinance, of the Code of Ordinances of the Ci ty of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> t..JHEREAS, said Ci ty Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the pub 1 i c
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the following described trac t of real property
<br /> located in San Marcos, Hays County, Texas, which is presently zoned
<br /> "M" (Single, Duplex and Neighborhood Businesses Dish-ict>
<br /> henceforth shall be rezoned "MF-3" (Mutli-Family District):
<br /> LOTS 8, 9 AND 10 OF THE B.G. COLLIER SUBDIVISION NEAR SAN
<br /> MARCOS, HAYS COUNTY, TEXAS, A PORTION OF THE J .M. VERAMEND I
<br /> SURVEY, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUt1E 108, PAGE
<br /> 34, OF THE HAYS COUNTY DEED RECORDS.
<br /> SECT! ON 2. That the following described tract of real property
<br /> located in San Marcos, Hays County, Texas, which is presently zoned
<br /> "M" (Single, Duplex and Neighborhood Businesses District)
<br /> henceforth shall be rezoned It1F-3" <f1utli-Family District):
<br /> Field Notes, compiled from records, of 0.194 of an acre of 1 and
<br /> out of and a part of the J.M. Veramendi League, situated in the
<br /> City of San Marcos, Texas, said 0.194 acre tract being more
<br /> particularly described as being a portion of that certain tract
<br /> of land conveyed to Leon R. King by deed of record in Volume
<br /> 219, Page 636 of the Deed Records of Hays County, Texas, said
<br /> 0.194 acre tract being mope fully described by metes and bounds
<br /> as follows:
<br /> BEGINNING at a point for the northwest corner of said King
<br /> tract, for the northwest corner of the tract herein described;
<br /> THENCE wi th the north 1 ine of said King t ~\ct N 46° 10" E 45.60
<br /> feet to a point at a fence corner for the noptheast corner of
<br /> the tract herein described;
<br /> THENCE wìth said fence the foll o~JÍ ng two (2) courses;
