<br />2 <br /> <br />ORDINANCE 1986-86 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING THE <br />RESULTS OF A BOND ELECTION HELD IN SAID CITY ON JULY <br />26, 1986, AND DECLARING AN EMERGENCY. <br /> <br /> <br />WHEREAS, this City Council duly authorized an election to be held <br />within said City on July 26, 1986, for the purpose of submitting to the <br />resident qual ified electors of said City the proposition hereinafter <br />set forth; <br /> <br />WHEREAS, this City Council has investigated all matters pertaining <br />to said election; and, <br /> <br />WHEREAS, the election officers who held said election have duly <br />made the returns of the results thereof, and said returns have been <br />duly delivered to this City Council; nol,.\', ther'efore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ~~ MARCOS, <br />TEXAS: <br /> <br />SECTION 1. FINDINGS. That it is officially found and determined <br />that said election was duly ordered, that proper notice thereof was <br />duly given, that proper election officers were duly appointed prior to <br />said election, that said election was duly and lawfully held, that due <br />returns of the result of said election have been made and del ivered, <br />and that this City Council has duly canvassed said returns, all in <br />accordance with law and the Ordinance call ing said election. <br /> <br />SECTION 2. VOTES CANVASSED. That it is officially found and <br />determined that the following votes were cast at said election on the <br />submitted proposition by the resident qual ified electors of said City <br />who voted at said election: <br /> <br />PROPOSITION <br /> <br />THE ISSUANCE OF $17,100,000.00 REVENUE BONDS 808 VOTES: FOR <br />FOR PURCHASING, IMPROVING, EXTENDING AND <br />EQUIPPING AN ELECTRIC LIGHT AND POWER 74 VOTES: AGAINST <br />SYSTEM AND PLEDGING THE REVENUES OF SAID <br />SYSTEM TO THE PAYMENT OF THE BONDS. <br /> <br /> <br />SECTION 3. BONDS AUTHORIZED: That as a result of said election, <br />and in conformity with lalJJ, this City Council is a.uthorized to issue <br />the bonds of and on behalf of said City in the amount and for the <br />purposes mentioned in the proposition set forth in the proceedings <br />call jng said election, as and to the extent hereinabove provided as <br />having been approved by the resident qual ified electors of said City <br />voting at said election. <br /> <br />SECTION 4. EMERGENCY DECLARATI&~: That the public importance of <br />this measure and the fact that it is to the interest of the City and <br />its inhabitants to provide funds for the purposes herein contemplated <br />at the earl iest possible date for the immediate preservation of the <br />publ ic peace, health and safety constitute an emergency and an <br />imperative publ ic necessity, requiring that this Ordinance take effect <br />and be in full force immediately upon its passage, all ordinance and/or <br />Charter rules requiring ordinances to be presented at three (3) <br />separate meetings are hereby dispensed with for the purpose of <br />adopting this Ordinance as an emergency ordinance; and this Ordinance <br />shall take effect and be in full force and effect from and after its <br />final passage as provided by the Charter of said City. <br /> <br />PASSED, APPROVED AND ADOPTED .t~. 28..... d'..' of JUlY.
