<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ~1ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />CHANGING THE ZONING OF 10.00 ACRES OF LAND OUT OF THE
<br />J.M. VERAMENDI LEAGUE NO.2, HAYS COUNTY, TEXAS BEING A
<br />PORTION OF THAT TRACT OF LAND DESCRIBED AS TRACT THREE
<br />C~~EYED TO JACK F. HARPER AND MURRAY M. HARPER BY D.D.
<br />WATSON BY DEED DATED NOVEMBER 9, 1960, AND RECORDED IN
<br />VOLUME 184, PAGE 207, HAYS COUNTY DEED RECORDS, SAME BEING
<br />A PORTION OF THAT TRACT OF LAND DESCRIBED AS TRACT THREE
<br />CONVEYED TO MURRAY M. HARPER BY JACK F. HARPER BY DEED
<br />DATED JUNE 5, 1968, AND RECORDED IN VOLUME 224, PAGE 235,
<br />HAYS COUNTY DEED RECORDS, AND LOCATED NORTH OF HIGHWAY
<br />80 AND l-\lEST OF RIVER ROAD, FROM "C" (COMMERCIAL DISTRICT)
<br />TO "MF-4" (MULTI-FAMILY DISTRICT); AND DECLARING AN
<br />EFFECTIVE DATE.

<br />WHEREAS, on May 20, 1986, the Zoning Commission of the City of
<br />San Marcos held a pub 1 ic hearing regarding a request to change the
<br />zoning from "C" (Commercia}) to "M-4" (Multi-Fam.ily District) of
<br />10.00 acres of land out of the J.M. Veramendi League No.2, in the
<br />City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said pub 1 ic hearing on said date, said
<br />Commission did, on May 20, 1986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a publ ic hearing on the 11 day
<br />of August, 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the pub 1 ic
<br />hea Uh, morals, !..<Ie Hare and safe ty; nO\AJ, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CIrt OF SAN MARCOS, TEXAS:

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />"C" (Commercial) henceforth shall be rezoned "MF-4" (Multi-Family
<br />District):

<br />RECORDED IN VOLUME 224, PAGE 235, HAYS COUNTY DEED RECORDS AND
<br />BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
<br />FOLLOWS, TO-WIT:

<br />BEGINNING at an iron stake found at the IJlest corner of that 4
<br />acre tract of land conveyed to Jack F. Harper and Murray M.
<br />Harper, by D.D. IJlatson, by deed dated April 11, 1955, and
<br />recorded in Volume 164, Page 265, Hays County Deed Records, same
<br />being on the Northeast I ine of that 50 acre tract of land
<br />conveyed to Katherine Thompson Rich by W.H. Thompson by deed
<br />dated October 1, 1942, and recorded in Volume 125, Page 253,
<br />Hays County Deed Records, for the most Southerly corner of the
<br />tract herein described;
