<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />~ MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING PREVIOUSLY UNZONED PROPERTY AS "C" (COMMERCIAL
<br />DISTRICT), BEING 3.14 ACRES, MORE DR LESS, OF
<br />LAND IN THE J.M. VERAMENDI SURVEY NO. 1, AND THE B.
<br />O~KANE SURVEY, BEING A PORTION OF THAT TRACT DESCRIBED AS
<br />75 PERCENT OF 62.235 ACRES IN A DEED FROM JIM R. SMITH TO
<br />JAY WILLIAMSON, TRUSTEE DATED JUNE 4, 1985 AND RECORDED IN
<br />VOLUME 529, PAGE 250 OF THE HAYS COUNTY REAL PROPERTY
<br />RECORDS AND THAT TRACT DESCRIBED AS 25 PERCENT OF 62.235
<br />ACRES IN A DEED FROM SECOND BAPTIST CHURCH TO JAY
<br />WILLIAMSON, TRUSTEE DATED JUNE 4, 1985 AND RECORDED IN
<br />VOLUME 529, PAGE 254 OF THE HAYS COUNTY REAL PROPERTY
<br />RECORDS, AND LOCATED IN THE VICINITY OF FM 621; AND
<br />DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on June 3, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to zone
<br />previously unzoned property as "C" (Commercial District), being 3.14
<br />acres, more or 1 ess of 1 and in the J .t1. Veramend i Survey No. 1 and
<br />the B. O~Kane Survey in the City of San Marcos, Hays County, Texas;
<br />and,
<br />
<br />WHEREAS, subsequent to said publ ic hearing on said date, said
<br />Commission did, on June 3, 1986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said CitYJ and,
<br />
<br />WHEREAS, said City Council held a publ ic hearing on the 11 day
<br />of August, 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />Unzoned henceforth shall be zoned "C" (Commercial District):
<br />
<br />DESCRIPTION OF 3.14 ACRES, MORE OR LESS, OF LAND IN THE J.M.
<br />VERAMENDI SURVEY NO. 1, AND THE B. O~KANE SURVEY, BEING A
<br />PORTION OF THAT TRACT DESCRIBED AS 75 PERCENT OF 62.235 ACRES IN
<br />A DEED FROM JIM R. SMITH TO JAY WILLIAMSON, TRUSTEE DATED JUNE
<br />4, 1985 AND RECORDED IN VOLUME 529, PAGE 250 OF THE HAYS COUNTY
<br />DEED RECORDS AND THAT TRACT DESCRIBED AS 25 PERCENT OF 62.235
<br />ACRES IN A DEED FROM SECOND BAPTIST CHURCH TO JAY WILLIAMSON,
<br />TRUSTEE DATED JUNE 4, 1985 AND RECORDED IN VOLUME 529, PAGE 254
<br />OF THE HAYS COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY
<br />DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

<br />Beginning at an 1/2 inch iron rod found in the southwest 1 ine of
<br />F.M. Highway No. 621 for the north corner of the Will iamson
<br />62.235 acre tract, same being the north corner of this tract;
<br />
<br />THENCE 1 eav i ng the PLACE OF BEGINNING with the common 1 i ne of
<br />F.M. Highway No. 621 and the Will iamson 62.235 acre tract the
<br />foll~4ing four courses;
<br />
<br />1. With a right-breaking curve having the following
<br />characteristics, Delta= 07045-'09", Radius = 1105.91 feet,
<br />Arc = 149.64 feet, and a chord bearing of S24° 10~09"E
<br />149.52 feet to a Texas Highway Department concrete
<br />monument found,
