<br /> MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP)
<br /> OF THE i'1ASTER PLAN OF SAID CITY, FOR A 4.20 ACRE
<br /> TRACT OF LAND IN THE BENJAMIN J. WHITE SURVEY, ABSTRACT
<br /> NO. 469, AND THE T.H.W. FORSITH SURVEY, ABSTRACT NO. 173,
<br /> IN HAYS COUNTY, TEXAS, LOCATED ON THE SOUTHSIDE -Of
<br /> RANCH ROAD 12, ADJACe~T TO THE WEST OF THOMASON FUNERAL
<br /> HOME, FRO/'1 LOW DENSITY RESIDENTIAL TO COMt1ERCIAl; AND
<br /> DECLARING AN EFFECTIVE DATE.
<br /> WHEREA S, on March 18, 1986, the Joint Phnn i ng and
<br /> Zoning Commissions of the City of San Marcos held a publ ic hearing
<br /> regarding a request to amend the Future Land Use Plan <r1ap) of the
<br /> t1aster Pi an from Low Density Residential to Commercial for a 4.20
<br /> acre tract of land in the Benjamin J. lIlhi te Survey, Abstract No. 469,
<br /> and the T .H.!"J, Forsith Survey, Abstract No. 173, Hays County, Texas;
<br /> and,
<br /> l.JHEREAS, subsequent to said pubi ic hearing on said date, said
<br /> Commissions did, on June 17, 1986, consider said request and
<br /> \Joted to approve the same and have recommended that such request be
<br /> approved by the City Council of said City; and,
<br /> WHEREAS, said City Council held a publ jc hearing on the 11 day
<br /> of Augus~ 1986, regarding such request; and,
<br /> f..<IHEREAS, all requirements of the Master Plan pertaining to
<br /> amendments have been met; and,
<br /> l,.JHEREAS, said Ci ty Council hereby finds and determines that the
<br /> adoption of the follo~'ing resolution is in the interest of the public
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN NARCOS, TEXAS:
<br /> PART 1. That the follrn4ing described tract of real property
<br /> located on the south side of Ranch Road 12, adjacent to the west
<br /> of Thomason Funeral Home, San Marcos, Hays County, Texas, lAth i chi s in
<br /> an area shown on the Future Land Use Pian (Map) of the Master Pi an
<br /> of the City of San Marcos as Low Density Residential shall be shown on
<br /> said map as Commerciai:
<br /> FIELD NOTE DESCRIPTION OF A 4.20 ACRE TRACT OF LAND SITUATED IN
<br /> THE BENJAMIN J. WHITE SURVEY, ABSTRACT NO. 469, AND THE T.H.W.
<br /> FORSITH SURVEY, ABSTRACT NO. 173, IN HAYS COUNTY, TEXAS, SAI D
<br /> TRACT HEREIN DESCRIBED AS FENCED AND USED UPON THE GROUND THIS

<br /> BEGINNING at a point in the south ¡ ine of Ranch Road No. 12,
<br /> said point bears S 83°51'E, a distance of 281.3 feet from a
<br /> concrete monument found in said south 1 ine of Ranch Road No. 12
<br /> at Engineers Stat i on 660+35.5, and said point being the
<br /> northeast corner of a 3.864 acre tract as conveyed to Li 11 i an
<br /> Avey Schlameus by deed recorded in Voiume 213, Page 563 of the
<br /> Hays County, Texas Deed Records and also being the nol"thl.IJest
<br /> corner hereof;
<br /> THENCE with the said south i ine of Ranch Road No. 12, same being
<br /> the north 1 ine hereof, a distance of 180.87 feet along the arc
<br /> of a curve to the right, having a central angle of 4°37'19" and
<br /> a radius of 2242.11 feet and whose chord bears S 7~30' 05"E, a
<br /> distance of 180.82 feet to a point in the northeast fence corner
