<br />54 <br /> <br /> <br />a"" ORDINANCE 1986-98 <br />-1 <br />=' <br />.., <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 21 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY REPEALING THE CURRENT SECTI~~ <br />21-39 (COMPENSATION); ADDING A NEW SECTION 21-39 WHICH <br />PROVIDES FOR NEW RATES FOR SPECIAL ASSIGNMENT SE~)ICES; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 21-39 of the San Marcos Code of <br />Ordinances shall be repealed. <br /> <br />SECTION 2. That Section 21-39 of the San Marcos Code of <br />Ordinances shall be adopted to read as follows: <br /> <br />Sec. 21-39. Compensation. <br /> <br />a. The City shall charge a fee for these services in the <br />amount of $19.00 per Pol ice Officer per hour to be <br />distributed as follows. <br /> <br />$15.00 per hour to the Pol ice Officer <br />4.00 per hour to the City to cover employee benefit <br />costs for the employee and administrative costs. <br /> <br />b. The City Pol ice Officers may worK in uniform or in <br />plain clothes at the discretion of the Chief of <br />Police. <br /> <br />c. The contractor will deposit the required fee with the <br />Finance Department of the City at least fourteen (14) <br />days prior to the date of the function for which services <br />are requested. If the request for services is cancelled <br />seventy-two (72) hours or more before the function, the <br />City will refund the fee. If the request for services is <br />cancelled less than seventy-two (72) hours before the <br />function, the City will retain the fee and pay the officer <br />for the services they would have performed had the <br />function not been cancelled. The Chief of Police will not <br />approve any request for less than two (2) officer hours. <br />The time periods establ ished by this section may be waived <br />for good cause at the discretion of the Chief of Pol ice. <br />A deposit may be maintained with the City for any period <br />of time in the form of cash or other type of security <br />acceptable to the Director of Finance with the approval of <br />the City Attorney. <br /> <br />d. Failure to pay fees for services shall be a Class <br />C misdeameanor. Each day the fees are not paid after <br />ten (10) days from notice that the fees are due shall <br />constitute a separate offense. Any fines collected from <br />prosecution of a violation of this ordinance shall <br />be paid to the City in addition to payment of fees for <br />services. <br /> <br /> <br />SECTION 3. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be publ ished in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading July 14,1986. <br /> <br />PASSED AND APPROVED on second reading July 28, 1986. <br /> <br />PASSED, APPRDVED AND ADDPTED Augus ~~~/ <br /> <br /> <br />Y.E.
