<br /> E¥1~ I -:£-i ---¡ l, 1=/) <br /> OPERATING AGREEMENT <br /> BETWEEN <br /> LOWER COLORADO RIVER AUTHORITY <br /> AND <br /> THE CITY OF SAN MARCOS, TEXAS <br /> This Agreement between LOWER COLORADO RIVER AUTHORITY <br /> (hereinafter "LCRA"), a public corporation created and existing <br /> under and by virtue of the laws of the State of Texas with its <br /> principal office at Austin in Travis County, Texas, and THE <br /> CITY OF SAN MARCOS (hereinafter "CITY"), a municipality organ- <br /> ized and existing under the laws of the State of Texas, located <br /> in Hays County, Texas. <br /> WITNESSETH: <br /> WHEREAS, LCRA is the owner and operator of dams, <br /> hydro-electric plants, power stations, transmission lines and <br /> distribution facilities and is engaged in the generation, <br /> transmission, distribution and sale of electric power and <br /> energy in the area certificated to LCRA by the Texas Public <br /> Utility Commission in which CITY is located; and <br /> WHEREAS, under an Amendment to Memorandum of <br /> Understanding dated June 6, 1986, LCRA has agreed to sell and <br /> convey to the CITY and the CITY has agreed to purchase all of <br /> -1- <br />
