<br /> 62 <br /> RESOLUTION 1986-95B <br /> RESOLUTION <br /> OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS APPROVING IN PRINCIPLE THE <br /> PROPOSED PURCHASE AGREEMENT BETWEEN THE <br /> LOWER COLORADO RIVER AUTHORITY AND THE <br /> CITY OF SAN MARCOS FOR THE PURCHASE OF <br /> CERTAIN ELECTRIC UTILITY DISTRIBUTION <br /> AND GENERAL PLANT FACILITIES SERVING <br /> THE CITY; AUTHORIZING THE MAYOR TO SIGN <br /> THE PURCHASE AGREEMENT AFTER ALL FINAL <br /> REVISIONS ARE INCORPORATED INTO THE AGREE- <br /> MENT; AND REQUESTING THAT THE PROPOSED <br /> PURCHASE AGREEMENT BE RE-SUBMITTED TO <br /> THE CITY COUNCIL FOR ITS FINAL APPROVAL <br /> WHEl{EAS, the City of San Marcos and the Lower Colorado <br /> River Authority (LCRA) executed a Memorandum of Understanding on <br /> June 6, 1986 relating to the purchase by the City of LCRA's <br /> Electric Utility Distribution and General Plant Facilities <br /> currently serving the City; and <br /> WHEREAS, the Memorandum of Understanding specified that <br /> the specific provisions relating to the purchase were to be set <br /> out in a Purchase Agreement, a Wholesale Power Agreement, an <br /> Operating Agreement and a Technical Services Agreement; and <br /> WHEREAS, the City Manager of the City of San Marcos and <br /> the General Manager of LCRA have negotiated a proposed Purchase <br /> Agreement attached as Exhibit "A" and incorporated herein for all <br /> purposes; and <br /> WHEREAS, the staff and consultants employed by the City <br /> of San Marcos have reviewed the proposed Purchase Agreement and <br /> recommend that it be approved in principle by the City Council. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS: <br /> 1. The proposed purchase by the City of LCRA's Electric <br /> Distribution and General Plant Facilities currently <br /> serving the City is in the publ ic interest. <br /> 2. The proposed Purchase Agreement between the City of <br /> San Marcos and LCRA attached to this Resolution as <br /> Exhibit IIAII is hereby approved in principle. <br /> 3. The Mayor of the City of San Marcos is hereby <br /> authorized to execute this Purchase Agreement after <br /> any final revisions are incorporated into the <br /> Agreement. <br /> 4. The final draft of the Purchase Agreement shall be <br /> re-submitted to the City Council for its final <br /> approval. <br /> 5.
