BILL OF SALE STATE OF TEXAS S KNOW ALL MEN BY THESE PRESENTS: COUNTY OF BAYS S That the LOWER COLORADO RIVER AUTHORITY, a governmental agency created by and operating under and pursuant to the pro- visions of Chapter 7 of the C~neral Laws enacted by the Porty-Third Legislature of the qtate of Texas in its Pourth Called Session, as amended (herein referred to as "Seller"), of Travis County, Texas, acting herein by its duly authorized officers, for and in consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) and other valuable consideration, to the undersigned paid by THE CITY OF SAN MARCOS, A Municipal Corporation, created and existing under the Home Rule Charter and the laws of the State of Texas (herein referred to as "Buyer"), the receipt of which is hereby acknowledged, has BARGAINED, SOLD and DELIVERED, and by these presents does BARGAIN, SELL an~ DELIVER, unto Buyer all of the personal property in Hays County, Texas, owned by Seller, more fully described in Pxhibit "A" attached to this instrument and incorporated herein for all purposes. Seller warrants that it is the lawful owner in every respect of all the herein described property and that it is free and clear of any and all liens, security interests, encumbrances, claims, demands, and charges of every kind and character whatsoever. Seller declares, with respect to the property being trans- ferred herein that it is BARGAINED, SOLD and DELIVERED "AS IS" and "WITH ALL PAULTS," and further that there are no warranties, express or implied, as to the condition, quality or use, except as hereinafter provided, and including, but not limited to, war- ranties of merchantability or fitness for a particular purpose or use.
