<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 <VOL. 66) BY
<br />CHANGING THE ZONING OF 4.61 ACRES, i"10RE OR LESS, OF
<br />LAND AREA, IN THE J.M. VERAMENDI SURVEY NO.1, SAN MARCOS,
<br />HAYS COUNTY, TEXAS, BEING A PORTION OF THAT TRACT
<br />DESCRIBED AS 88.28 ACRES, IN A DEED FROM ISOM H. HALE AND
<br />T. L. WEATHERS TO ADVENTIST HEALTH SYSTEM/SUNBELT, INC.
<br />DATED APRIL 20, 1981 AS RECORDED IN VOLUME 356, PAGE 676
<br />OF THE HAYS COUNTY DEED RECORDS, AND LOCATED ON THE
<br />NORTHEAST CORNER OF WONDER WORLD DRIVE AND WEST OF
<br />HIGHIAAY 123 FRDr'1 "R-1" (SINGLE FAtiIlY DJAIELLING DISTRICT)
<br />TO "C" <COMt1ERCIAL DISTRICT); AND DECLARING AN EFFECTl'JE
<br />DATE.

<br />WHEREAS, on July 1, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to change the
<br />zoning fr.om "R-l" (Single Famib' DI'H"ì1ing District) to "C"
<br />(Commercial District) of 4.61 acres of land out of the J.M.
<br />Veramendi Survey No.1, in the City of San Marcos, Hays County, Texas;
<br />and,
<br />
<br />WHEREAS, subsequent to said publ ic hearing on said date, said
<br />Commission did, on July 1, 1986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />!,t)HEREAS, said City Council held a public hea.ring on the 25 day
<br />of August, 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, Generai Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />"R-1" (Single Family Dt^¡elling District) henceforth shall be rezoned
<br />"C" (Commercial District):

<br />DESCRIPTION PREPARED FOR ZONING PURPOSES ONLY, OF 4.61 ACRES,
<br />MORE OR LESS, OF LAND AREA, IN THE J.M. VERAMENDI SURVEY NO.
<br />1, SAN ~ARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT
<br />TRACT DESCRIBED AS 88.28 ACRES, IN A DEED FROM ISOM H. HALE AND
<br />T. L. WEATHERS TO ADVENTIST HEALTH SYSTEM/SUNBELT, INC. DATED
<br />APRI L 20; 1981 AS RECORDED IN VOLUt1E 356, PAGE 676 OF THE HAYS
<br />COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY DESCRIBED BY
<br />METES AND BOUNDS AS FOLLOWS:

<br />COMMENCING at a half inch iron rod found in the southeast 1 ine
<br />of De] Sol Drive (50~ R.O.W.) for the north corner of the
<br />Adventist Health System 88.28 acre tract and the east corner
<br />of that 24.0 acre tract described in a deed from John W.
<br />Nigl iazzo and Charles E. Blake to S.M.C.I.S District dated
<br />April 4, 1967 and recorded in Volume 217, Page 186 of the
<br />Hays County Deed Records;
<br />
<br />THENCE with the North 1 ine of the 88.28 acre tract the following
<br />t\.<10 courses:
<br />
<br />1. S45°16~E 409.88 feet to a half inch iron rod found,
<br />2. With a left-breaking curve having the following
<br />characteristics: Delta = 26°53~03", Radius = 832.23 feet,
<br />Arc = 390.50 feet and a chord which bears S58~2~E 386.92
<br />feet to an angle point;
<br />
<br />THENCE entering the 88.28 acre tract the following two courses:

<br />1. S41°57'E 395.72 feet to an angle point,
