<br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF TRACT 1: LOT 4 AND PART OF LOT 3
<br /> BEING PART OF THE C.L. MCGEHEE ADDITION TO THE CITY OF
<br /> SAN MARCOS, TEXAS AND BEING ALSO A PART OF TWO TRACTS OF
<br /> LAND CONVEYED TO F.W. FELTNER ET UX TO A & W CONSTRUCTION
<br /> COMPANY IN A DEED RECORDED IN VOLUME 266 PAGE 133 OF THE
<br /> DEED RECORDS OF HAYS COUNTY, TEXAS AND TRACT 2: BEING A
<br /> PART OF LOT 5 OF THE C.L. MCGEHEE ADDITION TO THE CITY
<br /> OF SAN t'1ARCOS AND BEING ALSO A PART OF A TRACT OF LAND
<br /> DESIGNATED AS SECOND TRACT IN A DEED FROM F.W. FELTNER TO
<br /> A & W CONSTRUCTION COMPANY AND RECORDED IN VOLUME 266 PAGE
<br /> 133 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, A/KIA 202-
<br /> 216 SCOTT STREET FROM "j'1F-4" <i'1ULTI-FAi"IILY DISTRICT) TO
<br /> "TH-2" (TO(JJNHOUSE DISTRICT); AND DECLARING AN EFFECTIVE
<br /> DATE.
<br /> I/JHEREAS , on Ju i;, 1, 1986, the Zoning Commission of the City of
<br /> San Marcos held a publ ic hearing regarding a request to change the
<br /> zoning fr'om "MF-4" (Multi-Family District) to "TH-2" (Tol,'H'\house
<br /> Distr'ict:J of Lot 4 and par t of Lots 3 & 5 of the C.L. ¡'1cGehee
<br /> Addition, in the City of San t1arcos, Hays County, Texas; and,
<br /> !,\IHEREAS, subsequent to said publ ic hearing on said date, said
<br /> Commission did, on I.iu 1 y 1, 1986, consider said request and
<br /> voted to approve the same and has recommended that such request be
<br /> appro!Jed b>' the City Counc i i of said Ci ty; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 25 day
<br /> of August , 1986, regarding such request; and,
<br /> !."¡HEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the Ci ty of San Narcos
<br /> pertaining to amendments have been met; and,
<br /> IAHEREAS, said Ci ty Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the publ ic
<br /> heaith, morais, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the fol10win9 described tracts of rea 1 proper ty
<br /> located in San Marcos, Hays County, Texas, which are presently zoned

<br /> the City of San Marcos, Texas and being also a part of two

<br /> Construction Company in a deed recorded in Volume 266 Page 133
<br /> of the Deed Records of Hays Coun t:" Texas and being more
<br /> particularly described as follows:
<br /> BEGINNING at an iron pin set in the intersection of the NW 1 ine
<br /> of HopKins Street and the NE 1 ine of Scott Street in the South
<br /> corner of the First Tract in the above mentioned conveyance for
<br /> the South corner of this tract also being the South corner of
<br /> lot 4.
<br /> THENCE N 45°001 W with the NE j ine of Scott Street 161.961 to an
<br /> iron pin set for the West corner of this tract.

<br /> THENCE N 45 00" E 77.001 to an iron pin set in the NE 1 ine of
<br /> the Second Tract in the said conveyance for a reentrant corner
<br /> of this tract.
