<br />108 <br /> <br /> <br /> <br /> <br />THE STATE OP TEXAS § <br />COUNTY OF CALDWELL § <br /> <br /> <br />LEASE <br />-- <br /> <br /> <br /> <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />WHEREAS, the City of San Marcos, Texas, is the owner of the San <br /> <br />Marcos Munlc1pal A1rport, situated in Caldwell County, Texas, <br /> <br />herelnafter IIAl.rport,1I by virtue of an indenture from the United States <br /> <br />of Amer1ca dated the 24th day of February, 1966, and the 14th day of <br /> <br />Ju~y, 1969, and the 11th day of May, 1976, to WhlCh reference lS hereby <br /> <br />mad e; and <br /> <br />WHEREAS, John J. Stokes, Sr., whose local address is at 1122 <br /> <br />Seguin Highway, San Marcos, Texas, 78666, a private cl.tizen, operating <br /> <br />aircraft out of the San Marcos Municipal Alrport, desires to obtain <br /> <br />from the Clty of San Marcos a land lease upon which to construct an <br /> <br />aircraft storage facility as described in paragraph five (5) <br />hereinbelow described; ana <br />WHEREAS, the C1ty of San Marcos, as Lessor, in order to effectuate <br /> <br />use of the subJect premises to construct such storage fac1Lity desires <br /> <br />to enter into a lease of a portion of such Airport with John J. Stokes, <br /> <br />Sr., as Lessee, and John J. Stokes, Sr. does desire to lease such <br /> <br />property for the construction of a storage facility for aircraft in <br />accordance with the followlng terms and conditions: <br />WITNESSETH: <br /> <br />1. Demisea Premises. <br /> <br />The Clty of San Marcos, herel.nafter called Lessor, herebY <br /> <br />leases to John J. Stokes, Sr., hereinafter called Lessee, and <br /> <br />sald Lessee rents from Lessor that certain premises <br /> <br />containing 15,000 square feet, more or less, described and <br /> <br />identified in Exhib1t A attached hereto ana incorporated by <br /> <br />reference hereln. For the purposes of this lease, thlS <br /> <br />property is deemed to be unimproved. <br /> <br />2. Survey. <br /> <br />Lessor agrees to cause an exact survey to be made of sald <br /> <br />premises, at Lessor's expense, and both parties agree that <br /> <br />this survey will be made a part of this Agreement. <br />
