<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />~ MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />~ REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />CHANGING THE ZONING OF LOTS 96 & 97, THIRD DIVISION OF
<br />PARK DIVISION TO THE CITY OF SAN MARCOS, TEXAS AS RECORDED
<br />IN VOLUME 56, PAGE 47 OF THE HAYS COUNTY DEED RECORDS,
<br />A/K/A 926 CHESTNUT STREET FROM "R-l" (SINGLE FAMI LY
<br />DWELLING DISTRICT) TO "MF-l" (MULTI-FAMI LY DISTRICT); AND
<br />DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on August 5,1986, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "R-l" (Single Family Dwelling District) to "MF-l"
<br />(Multi-Family District) of Lots 96 and 97, Third Division of Park
<br />Division, San Marcos, Hays County, Texas and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on August 5,1986, consider said request
<br />and voted to deny the same; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 22nd day
<br />of September, 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />"R-l" (Single Family Dwelling District) henceforth shall be rezoned
<br />"MF-l" (Mutli-Family District):
<br />
<br />LOTS 96 & 97, THIRD DIVISION OF PARK DIVISION TO THE CITY OF SAN
<br />MARCOS, TEXAS AS RECORDED IN VOLUME 56, PAGE 47 OF THE HAYS
<br />COUNTY DEED RECORDS,
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on October 13,1986 it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall
<br />not go into effect if denied. If not reconsidered or if reconsidered
<br />and approved it shall be published in a newspaper of general
<br />circulation in the area as required by the Charter of the City of San
<br />Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this the 22nd day of September 1986,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for October 13, 1986.
