<br />50 <br /> <br /> <br />0 ORDINANCE 1986-123 <br />""" <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, ESTABLISHING INTERIM <br />ELECTRIC TARIFFS, INTERIM RULES AND <br />REGULATIONS FOR THE OPERATION OF THE ELECTRIC <br />DISTRIBUTION SYSTEM, AN INTERIM LINE EXTENSION <br />\n POLICY AND AN ELECTRIC UTILITY BOARD, <br />~ PROVIDING FOR THE POWERS AND DUTIES OF THE <br />BOARD, THE APPOINTMENT OF THE BOARD AND <br />SUCCESSOR BOARD MEMBERS AND OTHER MATTERS <br />PERTAINING TO THE BOARD'S ORGANIZATION AND <br />DUTIES, DECLARING AN EMERGENCY AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br /> <br /> <br />WHEREAS, at an election held 1n the City of San Marcos, <br />Texas, on July 26, 1986, the voters authorized the issuance of <br />$17,100,000.00 in electric utility system revenue Donas of said <br />City for the purpose of purchasing, improving, extena1ng ana <br />equipping an electric light ana power system for said City; and, <br /> <br />WHEREAS, 1n order to properly issue, sell ana deliver the <br />bonos authorizedDY that election it is necessary to estaúlish <br />interim electric tariffs, interim rules and regulations for the <br />electric system, an interim extension line pOlicy ana make <br />provis10ns for the appointment and powers of a City electric <br />ut111ty Doara; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. (1) The schedules of electric rates, attached <br />hereto as ExhiDit "A", are hereby estaDlishea as the 1nter1m <br />electric tariff to be charged and to be collected from customers, <br />as defined in the schedules, receiving electr1c service from the <br />City of San Marcos electr1c distribution system; (2) The electr1c <br />rate schedule shall be effective at 12:01 a.m. upon the effective <br />date of the purchase oy the City of San Marcos of its electr1c <br />distribution system from the Lower Colorado R1ver Authority; (3) <br />ana the rate schedule shall be applied to the customers of the <br />City of San Marcos electric distribution system upon the date next <br />following the date of termination of the customer's billing cycle <br />under the Lower Colorado R1ver Authority's billing system for <br />customers in the San Marcos district. <br /> <br />SECTION 2. The Rules and Regulations for Electric Service <br />ana L1ne Extension Policy, attached hereto as Exhibit "A" are <br />hereby established as the interim Rules ana Regulations for <br />Electric Service and Line Extension Policy applicaDle to all <br />customers of the City of San Marcos electric distribution system <br />and shall apply beginning at 12:01 a.m. of the effective date of <br />purchase by the City of San Marcos of its Electric Distr1úution <br />System from the Lower Colorado River Authority. <br /> <br />SECTION 3. The provisions of Sections 1 and 2 aDove shall <br />be added to the Code of Ordinances of the City of San Marcos, <br />Texas, ana the provisions of Section 2 shall be included w1thin <br />the SUbdivision Regulations ana Platting Requirements of the City <br />of San Marcos, Texas, ana shall be applicable both w1th1n the <br />corporate limits of the City of San Marcos, ana 1ts <br />extraterritorial jurisdiction, to the extent such territory 1S <br />included w1thin the Certificate of Public Convenience ana <br />Necessity granted to the City of San Marcos Dy the Public Utility <br />Commission of Texas for the retail distriúution of electr1c <br />service. <br /> <br />SECTION 4. Electric Utility Board. <br /> <br />(a) That pursuant to the authority granted by Art. 1115, <br />V.T.C.S., the City's electric system shall be managed by a board <br />of trustees to De known as the "Electric Utility Board" (the <br />Boara), consisting of four appointed members who are resident, <br />qualified voters of the City and rate-payers of the electric <br />system, and the Mayor of the City. <br />
