INTERLOCAL COOPERATION AGREEMENT <br />BETWEEN <br />THE CITY OF SAN MARCOS AND TEXAS STATE UNIVERSITY <br />This Interlocal Cooperation Agreement (the "Agreement ") is made and effective as of <br />November 19, 2013 (the "Effective Date ") by and between the City of San Marcos, Texas (the <br />"City "), 630 East Hopkins Street and Texas State University ( "Texas State "), 601 University <br />Drive, San Marcos, Texas 78666. The City and Texas State are each referred to hereinafter as a <br />"Party" and collectively as the "Parties." <br />ARTICLE I <br />RECITALS <br />1. The Texas Interlocal Cooperation Act, Section 791.001, et seq. of the Texas <br />Government Code authorizes the Parties to contract with each other to perform governmental <br />functions and services. <br />2. The City operates a reclaimed water system and Texas State wishes to receive <br />reclaimed water service from the City in the future. <br />3. The City is engaged in the construction of wastewater facilities in connection with <br />the Sessom Creek Wastewater Improvements Project, the limits of which are adjacent to the <br />Texas State campus. Because of the proximity of the project to the Texas State campus the <br />Parties have determined that it would be cost effective to install a segment of pipeline for the <br />delivery of reclaimed water to Texas State while the work on the Sessom Creek Wastewater <br />Improvements Project is being performed. This segment will connect to the segment being <br />installed in the Downtown Reconstruction Project and will form the pipeline route for future <br />reclaimed service to the University. <br />4. Adding the reclaimed waterline to the City's contract for the Sessom Creek <br />
