A determination as to '"Ihether a lot is within, <br />or a private- s:.ellJage facil it; VJould penetrate the Edv,!ards <br />and Associated Limestone shall be made by the Director of <br />Environment and Engineering based on competent geological <br />infor'mation to include, but may not be limited to, the <br />del ineation of the Edw~rds Aquifer Recharge Zone by the <br />iexas Water Commission, information from the Edwards <br />Underground Water District and the Edwards Aquifer <br />Research and Data Center or the successors of any such <br />agencies, pp.rcolation tests, core s.amples and/or iJther <br />such tests and data as may be required by the <br />Director of Environment and Engineering. <br /> <br />SECTION 3. That Article 1)1; Section H subsections 3a, 3b and 3.î <br />of the Subdivision Ordinance of the City of San Marcos be deleted <br />thel'efrcfm .3.nd transferred to Art i c J e ¡,.JI, See t ion r'¡ of the Subd i Ii i s i 011 <br />Ordinance to read as follows: <br /> <br />3. <br /> <br />Minimum Lot Sizes Over <br />Associated Limestone. <br /> <br />The <br /> <br />Ou tcrop (Jf the Edl.,'!ards <br /> <br />and <br /> <br />;:¡ . <br /> <br />The minimum size of a Jot within the outcrop of the <br />Edwards and Associated Limestone which uti] izes private <br />S!H<I;:I,ge '!'a.cilities, or ,;i lot IJ.)hich utilizes a pri'.!¿d:e <br />sewage {acil ity that will penetrate the Edwards and <br />Associated Limestone, ShBll be the same minimum lot <br />size that is requir'ed under Title 31, Par't 331, <br />Subchapter A of the Texas Water Code and the rules of <br />the Texas Water Development 80a~d for the Edwards <br />Aquifer, and as hereafter amended. <br /> <br />b. <br /> <br />A determination as to whether a lot is within or a <br />prÎ'.iate sell.,lage facility lili11 penetrate the Edl'lards and <br />Associated Limestone shall be determined as in ArticJe <br />VI, Section M of this regulation. <br /> <br />c. <br /> <br />Notwithstanding subsection 3 above, when private sewage <br />facilities are to b~ utilized on a lot, the 1ot shall <br />be designed to accommodate the proper and effective <br />function of the private sewage facil ity and if a <br />pri\late 'Alate.. Lots u'.:. i ng <br />private sewage faci¡ ¡ties shall be designed or <br />configured based on results from a minimum of one (1) <br />percolation test for every two (2) acres and one (1) <br />core sample for el!er'y filiI? (5) acr'es, soil sampJes, and <br />other tests as required by the Director of Environment <br />and Engineering or the P1anning Commission. Additional <br />percol~tion tests and core samples may be ordered if <br />results of previous tests in the immediate area, <br />geological evidence of unusual faulting, fractures Dr <br />other recharge structures, and the size of the <br />subdivision warrant such additional tests as determined <br />by the Director of Environment and Engineering, <br /> <br />SECTION 4.
