<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND
<br />CONTAINING 1.44 ACRES SITUATED IN THE R.H. WILLIAMS
<br />SURVEY ABSTRACT NO. 470 AND THE T. J. CHAMBERS
<br />SUR~JEY-ABSTRACT NO.2 IN HAYS COUNTY, TEXAS, SAID 1.44
<br />ACRE TRACT BEING A PORTION OF THE REMAINDER OF A 232.1
<br />ACRE TRACT OF LAND DESCRIBED IN A DEED TO MILTON DANIEL
<br />aUIE PROPERTIES PARTNERSHIP AS RECORDED IN VOLUME 399,
<br />PAGE 326 OF THE HAYS COUNTY DEED RECORDS, SAID LAND
<br />BEING LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION
<br />OF SAID CITY AND LYING ADJACENT TO PRESENT CITY
<br />BOUNDARIES; APPROVING A SERVICE PLAN FOR SAID TRACT;
<br />EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO
<br />INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS OF SAID
<br />TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS
<br />OF SAID CITY; BINDING SAID INHABITANTS BY ALL OF THE
<br />ACTS AND ORDINANCES, RULES AND REGULATIONS OF SAID CITY
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />provided an opportunity for all interested persons to be heard at two
<br />(2) publ ic hearings, held on August 11, 1986 ,and August 12, 1986,
<br />to consider the proposed annexation by the City of San Marcos, Texas,
<br />of 1.44 acre tract of land si tuated in the R.H. Wi 11 iams Surl}ey
<br />Abstract No. 470 and the T.J. Chambers Survey- Abstract No.2 in Hays
<br />County, Texas, said 1.44 acre tract being a portion of the remainder
<br />of a 232.1 acre tract of land described in a deed to Milton Daniel
<br />Buie Properties Partnership as recorded in Volume 399, Page 326 of the
<br />Hays County Deed Records, and being more particularly described by
<br />metes and bounds as follows:

<br />HUSTON AND ASSOCIATES, INC. FROM PUBLIC RECORD, OF A 1.44 ACRE
<br />TRACT OF LAND SITUATED IN THE R.H. WILLIAMS SURVEY ABSTRACT NO.
<br />470 AND THE T.J. CHAMBERS SURVEY-ABSTRACT NO.2 IN HAYS COUNTY,
<br />TEXAS, SAID 1.44 ACRE TRACT BEING A PORTION OF THE REMAINDER
<br />OF A 232.1 ACRE TRACT OF LAND DESCRIBED IN A DEED TO MILTON
<br />DANIEL BUIE PROPERTIES PARTNERSHIP AS RECORDED IN VOLUME 399,
<br />PAGE 326 OF THE HAYS COUNTY DEED RECORDS, SAID 1.44 ACRE TRACT,
<br />BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS

<br />COMMENCING at a 1/2-inch iron rod found for the most northerly
<br />east corner of a 43.11 acre tract (Tract 1) as described in a
<br />deed to Indian Creek Joint Venture as recorded in Volume 585,
<br />Page 868 of the Hays County Real Property Records, same being
<br />the common back corner of Lots 12 and 13, BlocK D of
<br />Castle Forest Subdivision, a subdivision of record in Book 2,
<br />Page 103 of the Hays County Plat Records, same also being a
<br />northerly corner of the said Buie Tract;
<br />
<br />THENCE with the southeast 1 ine of said 43.11 acre tract, same
<br />being the northwesterly 1 ine of said Buie Tract, the following
<br />two (2) courses and distances:

<br />S27°26/37"W, a distance of 153.66 feet to a l/2-inch
<br />rod, and
<br />

<br />S02° 51/44"E, a distance of 230.01 feet to a point in the
<br />present Corporate City Limit Line of the City of San
<br />Marcos, Texas according to City Ordinance 1970-9 for the
<br />north corner of the herein described tract and the POINT
<br />OF BEGINNING;

<br />THENCE departing the said southeast 1 ine of the 43.11 acre
<br />tract, same being the said northwesterly 1 ine of the Buie Tract,
<br />and crossing a portion of said Buie Tract, with said City Limit
<br />Line according to Ordinance 1970-9, S 45°00/00"t, a distance of
<br />395.00 feet to the present Corporate City Limit Line of said
<br />City according to City Ordinance 1973-4 for the east corner of
<br />the herein described tract;

<br />THENCE, continuing to cross said Buie Tract, with said City
<br />Limit Line according to Ordinance 1973-4, S 4~ OO/OO"I.<!, a
<br />distance of 180.83 feet to a point in the north 1 ine of a 1.81
<br />acre tract (Tract 2) as described in a deed to Indian Creek
<br />Joint Venture as recorded in Volume 585, Page 868 of the Hays
