39 RESOLUTION 1986-l20R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING SAID CITY'S ONE-YEAR PARTICIPATION IN PURCHASING PROGRAMS OF THE STATE PURCHASING AND GENERAL SERVICES COMMISSION FOR THE ACQUISITION OF AUTOMOBILES AND LIGHT DUTY TRUCKS, REQUESTING THE STATE PURCHASING AND GENERAL SERVICES COMMISSION TO INCLUDE SAID CITY'S STATED NEED FOR CONTRACT CLASS NO. 070, AUTOMOBILES AND LIGHT DUTY TRUCKS, ON THE COMMISSION'S ANNUAL CONTRACTS FOR THOSE ITEMS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN AND DELIVER ALL NECESSARY REQUESTS AND OTHER DOCUMENTS IN CONNECTION THEREWITH, DIRECTING THAT ALL DECISIONS OF THE CITY MANAGER RELATING TO SAID PURCHASING PROGRAMS SHALL BE AS DIRECTED BY THE CITY COUNCIL, PROVIDING THAT SAID CITY WILL PURCHASE SUCH ITEMS FROM THE CONTRACTS MADE PURSUANT TO THIS RESOLUTION AND ARTICLE 664-7, V.T.C.S., EXCEPT IN EMERGENCIES, AND THAT SAID CITY WILL BE RESPONSIBLE FOR PAYMENT DIRECTLY TO THE VENDOR UNDER EACH SUCH CONTRACT AND WILL BE RESPONSIBLE FOR THE VENDOR'S COMPLIANCE WITH ALL CONDITIONS OF DELIVERY AND QUALITY OF PURCHASED ITEMS, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, pursuant to the authority granted by Article 664-7, Vernon's Texas CiVll Statutes (V.T.C.S.) as amended, aeslres to participate in certain DeLow-aescrioea purchasing programs of the State Purchasing ana General Services Commission¡ ana, WHEREAS, the City CounciL of said City is of the opinion that participation in these programs WiLL be highly beneficiaL to the taxpayers of this City through the anticipated savings to De reaLlzea¡ now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the City of San Marcos, Texas, aoes hereby request the State Purchasing ana General SerVlces Commission to include saia City's stated need for Contract CLass No. 070, AutomoDiles ana Light Duty Trucks, on the Commission's annuaL contract for those items, whereby the City may be aLLowea to purchase those items from the annual contract in question. PART 2. That said City's partlcipation in such purchasing programs of the State Purchasing ana General Services Commisslon for the acquisltion of such items is hereDY authorizea. PART 3. That the City Manager, A.C. Gonzalez, is hereDY authorized ana airectea to slgn ana dellver all necessary requests ana other documents ln connection therewlth for ana on oehaif of sala City. PART 4. That all decislons of said City Manager relatlng to said purchasing programs will De airectea DY the City CounciL. PART 5. That the Clty of San Marcos, Texas, wilL purchase sala items from the contracts made pursuant to this Resolutlon ana ArticLe 664-7, V.T.C.S., except in emergencles, ana W1LL De responsiDLe for payment directLy to the vendor under each suCh contract ana will De responsible for the venaor's compliance wlth aLL conditions of aelivery ana quaLlty of purchased ltems.
