<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOT 1, BLOCK 1 OF THE GIESECKE ADDITION BEING 0.434
<br />ACRES MORE OR LESS OUT OF THE J. M. VERAMENDI SURVEY #2
<br />A-17, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, A
<br />SUBDIVISION IN THE CITY OF SAN MARCOS AS SHOWN ON THE
<br />MAP OR PLAT THEREOF RECORDED IN VOLUME 4, PAGE 160, OF THE
<br />HAYS COUNTY PLAT RECORDS; A/K/A 1115 HIGHWAY 80 FROM "OPII
<br />(OFFICE PROFESSIONAL DISTRICT) TO IIC" (COMMERCIAL
<br />DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on September 2, 1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "OP" (Office Professional District) to "CII
<br />(Commercial District) of Lot 1, Block 1 of the Giesecke Addition being
<br />0.434 Acres more or less out of the J.M. Veramendi Survey #2 A-17,
<br />San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on September 2, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />October, 1986, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />IIOP" (Office Professional District) be rezoned "CII (Commercial):
<br />
<br />LOT 1, BLOCK 1 OF THE GIESECKE ADDITION BEING 0.434 ACRES MORE OR
<br />LESS OUT OF THE J. M. VERAMENDI SURVEY #2 A-17, CITY OF SAN
<br />MARCOS, HAYS COUNTY, TEXAS, A SUBDIVISION IN THE CITY OF
<br />SAN MARCOS AS SHOWN ON THE MAP OR PLAT THEREOF RECORDED IN
<br />VOLUME 4, PAGE 160, OF THE HAYS COUNTY PLAT RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on November 10, 1986, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this the 27 day of October, 1986 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for November 10, 1986
