SECTION 4. Exemptions. This ordinance shall not apply to the following: <br />a. streets and rights -of -way where pedestrian or non - motorized vehicle use is <br />prohibited, such as interstate freeways; <br />b. when there is a documented absence of current or future need for a Complete <br />Street; or <br />C. when the accommodation is excessively disproportionate to the need, <br />probable use or cost of a proposed new, reconstructed, or maintenance street project. <br />A determination that one or more of the above exemptions applies shall require the joint <br />written concurrence of the Director of Public Services, Director of Engineering and the <br />Director of Planning. Further exemptions, as appropriate, may be established by ordinance in <br />conjunction with the development of specific street standards. <br />SECTION 5. Implementation. <br />a. Design. The City's Land Development Code and other development <br />ordinances, Transportation Master Plan, Thoroughfare Plan, Technical Construction <br />Standards and Specifications (TCSS) Manual and any successor ordinances or standards, as <br />applicable shall develop specific design recommendations that implement this ordinance. <br />The City shall incorporate best practices for design as presented by agencies such as the <br />American Association of State Highway and Transportation Organizations (AASHTO), <br />National Association of City Transportation Officials (NACTO), United States Department <br />of Transportation (USDOT), Federal Highway Administration (FHWA), Association of <br />Metropolitan Planning Organizations (AMPO), Institute of Transportation Engineers (ITE), <br />Transportation Research Board, Texas Department of Transportation (TxDOT), Capital <br />Area Metropolitan Planning Organization (CAMPO), and others as information becomes <br />available. <br />b. Collaboration. The City shall coordinate with The Texas Department of <br />Transportation, Capital Area Metropolitan Planning Organization, Texas State University, <br />Hays, Caldwell, Comal, and Guadalupe Counties to establish comprehensive Complete <br />Street standards. <br />C. Context Sensitive Solutions. Complete Streets shall be designed to <br />complement the surrounding public and private realm by preserving scenic, historic and <br />environmental resources. Context will determine appropriate modes and design on a project <br />by project basis. <br />d. Performance Measures. The Transportation Master Plan and other applicable <br />sources shall identify performance measures and procedures to track implementation of this <br />ordinance. <br />
