<br />55 <br /> <br />RESOLUTION 1986-122R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A PROPOSED PIPE LINE LICENSE <br />AGREEMENT WITH THE MISSOURI-KANSAS-TEXAS <br />(M-K-T) RAILROAD COMPANY FOR THE INSTALLATION <br />AND MAINTENANCE OF A TWELVE INCH (12") WATER <br />LINE UPON RAILROAD COMPANY RIGHT-OF-WAY IN <br />SAID CITY AT MILE POST M-51.26, AUTHORIZING <br />THE EXECUTION OF SAID AGREEMENT AND ANY AND <br />ALL OTHER DOCUMENTS AND INSTRUMENTS INCIDENT <br />TO THE PURPOSES THEREOF BY THE MAYOR, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on May 6, 1985, the City Council of the City of San <br />Marcos, Texas, adopted a resolution approving the terms and <br />conditions of a proposed Pipe Line License Agreement between said <br />City and the M-K-T Railroad Company for the installation and <br />maintenance of a twelve inch (12") water line upon railroad <br />right-of-way in said City; and, <br /> <br />WHEREAS, at such time the City contemplated contracting for <br />the performance of such installation; and, <br /> <br />WHEREAS, said City <br />itself; and, <br /> <br />now <br /> <br />desires <br /> <br />to <br /> <br />perform <br /> <br />such <br /> <br />services <br /> <br />WHEREAS, the M-K-T Railroad Company has not yet executed said <br />Agreement; and, <br /> <br />WHEREAS, said railroad company desires to enter into a <br />different form of Pipe Line License Agreement since the <br />installation of such pipe line is to be performed by the City; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN ~ßRCOS, <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of a proposed Pipe <br />Line License Agreement between said City and the <br />Missouri-Kansas-Texas Railroad Company for the installation and <br />maintenance of a twelve inch (12") water line upon railroad <br />right-of-way at Mile Post M-51.26, a copy of which is attached <br />hereto and incorporated herein for all purposes, are hereby in all <br />things approved. <br /> <br />PART 2. That the Mayor is hereby authorized to execute said <br />Pipe Line License Agreement on behalf of said City and any and all <br />other documents and instruments incident to the purposes thereof. <br /> <br />PART 3. That this Resolution <br />effect from and after its passage. <br /> <br />shall <br /> <br />be in full force and <br /> <br />ADOPTED this <br /> <br /> <br />Octobpx <br /> <br />, 1986. <br /> <br />E.
