E. <br /> <br />Workers' Compensation Interlocal and Supplement <br /> <br />Staff recommends Board approval of changes to the Workers' Compensation Joint <br />Insurance Fund Interlocal Agreement as follows: <br /> <br />1. The contract will be continuous, with provisions for annual contribution <br />change and provisions for termination both by the Member and the Fund. <br /> <br />2. The Members may terminate without giving 60 day notice if the reason <br />for termination is a contribution increase, which would impose undue <br />financial hardship. <br /> <br />3. Aggregate and <br />encompass the <br />protection. <br /> <br />catastrophic loss protection wording broadened to <br />possibility of not obtaining or self-funding such <br /> <br />4. Specific reference to Contractors and subcontractors by name is deleted. <br /> <br />5. Wording included to indicate that TML rates are developed by the Board <br />of Trustees, not by the State Board of Insurance, but using State Board <br />rates as guidelines. The Fund Discount is not quantified. <br /> <br />6. Definitions of "Fund Year" and "Agreement Period" added. <br /> <br />7. Relationship of TML staff and contractor as regards claims handling <br />outlined. <br /> <br />8. Payroll audit field visit criteria wording changed to reflect actual <br />practices. <br /> <br />9. Relationship of the Board, its agents and TML staff indicated. <br /> <br />10.
