<br />the purchase money because of failure or national moratorium of <br /> <br />operation of the banks, transfer agents, brokers, stock exchanges <br /> <br />or modes of transportation: or work stoppages: or restraint by <br /> <br />court order or other public authority: or action or inaction <br /> <br />concerning governmental or regulatory authorizations: or <br /> <br />transportation delay; or death or personal injury to a <br /> <br />representative of a Party whose signature is necessary, upon such <br /> <br />Party's giving notice and full particulars of such force majeure <br /> <br />in writing or by telephone to the other Party as soon as <br /> <br />reasonably possible after the occurrence of the cause relied upon, <br /> <br />the obligations of that Party giving such notice, so far as they <br />are affected by such force majeure, shall be suspended during the <br /> <br />continuance of any inability of performance so caused, but in no <br /> <br />event for longer than ninety (90) days. <br /> <br />Telephone notices given <br /> <br />under the provisions of Section 14.09(a) shall be confirmed <br />in writing as soon as reasonably possible and shall specifically <br /> <br />state full particulars of the force majeure, date when the force <br />majeure began and when the force majeure ceased or is expected to <br /> <br />cease. <br /> <br />This Agreement shall not be terminated by reason of any <br /> <br />such cause but shall remain in full force and effect. <br /> <br />Either <br /> <br />Party rendered unable to fulfill any of its obligations under this <br /> <br />Agreement by reason of force majeure shall exercise due diligence <br /> <br />to remove such inability with all reasonable dispatch. <br /> <br />The time <br /> <br />during which any force majeure occurrence results in the <br /> <br />suspension of obligations by a Party to this Agreement shall be <br /> <br />28. <br />
