<br />will apply in all cases unless a modification thereof with <br /> <br />respect <br /> <br />to <br /> <br />certain <br /> <br />delivery <br /> <br />points <br /> <br />now <br /> <br />in <br /> <br />existence <br /> <br />is <br /> <br />provided for in Exhibit A of this agreement. <br /> <br />B. <br /> <br />All revisions or modifications of rate schedules <br /> <br />and any modification of the terms of this contract shall be <br /> <br />under <br /> <br />the <br /> <br />circumstances <br /> <br />set <br /> <br />forth <br /> <br />and <br /> <br />according <br /> <br />to <br /> <br />the <br /> <br />procedures described in the General Terms and Conditions of <br /> <br />this contract. <br /> <br />In the event of any dispute arising under <br /> <br />this agreement with respect to LCRA's Schedule of Rates and <br /> <br />Charges then in effect for service rendered to Distributor, <br /> <br />Distributor shall, during the pendency of the dispute, pay <br /> <br />LCRA in accordance with the rates and charges applied by <br /> <br />LCRA <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />this <br /> <br />contract. <br /> <br />Upon <br /> <br />final <br /> <br />determination of the matter LCRA will refund to Distributor <br /> <br />the amounts, if any, that have been determined to have been <br /> <br />incorrectly billed. <br /> <br />4. <br /> <br />Non-waiver and Future Default: <br /> <br />No waiver by either <br /> <br />LCRA or Distributor of anyone or more defaults by the other <br /> <br />in the performance of any provisions of this agreement shall <br /> <br />operate or be construed as a waiver of any future default or <br /> <br />defaults, whether of a like or of a different character. <br /> <br />5. <br /> <br />Payment <br /> <br />to <br /> <br />LCRA <br /> <br />for <br /> <br />Electric <br /> <br />Power <br /> <br />and <br /> <br />Energy <br /> <br />Delivered: <br /> <br />Distributor agrees to pay LCRA each month for <br /> <br />electric power and energy in accordance with the terms and <br /> <br />conditions of this agreement. <br /> <br />6. <br /> <br />Liability: <br /> <br />The <br /> <br />Distributor <br /> <br />assumes <br /> <br />all <br /> <br />responsibility <br /> <br />for <br /> <br />the <br /> <br />electric <br /> <br />power <br /> <br />and <br /> <br />energy <br /> <br />after <br /> <br />-5- <br />
