Gonzalez <br />City Manager <br />City of San Marcos <br />City Hall <br />630 East Hopkins <br />San Marcos, Texas <br /> <br />78666 <br /> <br />Dear Mr. Gonzalez: <br /> <br />This letter confirms the supplemental agreement between the Lower Colorado <br />River Authority (lILCRAII) and the City of San Marcos (IICITY") in connection <br />with the purchase of certain facilities and property by the C ITV from LCRA <br />as follows: <br /> <br />1. <br /> <br />In order to provide CITY the opportunity to extend and/or expand its <br />system in an orderly manner, LCRA shall cooperate with the CITY and <br />make any surplus capacity in its existing transmission facilities available <br />to CITY for the purpose of establishing new delivery points. <br /> <br />2. <br /> <br />In the event of any disputes arising under this Agreement with respect <br />to LCRA's rate schedule then in effect for service rendered to the CITY, <br />the CITY shall, during the pendency of the dispute, pay LCRA in accor- <br />dance with the rates and charges applied by LCRA in accordance with the <br />Wholesale Power Agreement. Upon final resolution of the matter, LCRA <br />will refund to the CITY any amounts, including interest at the prime <br />rate quoted at the time of refund by the MBank, Austin, N.A., that <br />have been determined to have been incorrectly billed. <br /> <br />3. <br /> <br />The provisions of page 10 of Exhibit C to the Wholesale Power Agreement, <br />applicable to City, shall be as stated therein, except: <br /> <br />a. <br /> <br />The accuracy standard shall be 1% instead of 2%; and <br /> <br />b, <br /> <br />The period the adjustment will be made in City's bills for the <br />period the inaccuracy existed, if not determinable, shall be one- <br />half of the period, not to exceed six months (instead of three <br />months), since the last pr"evious meter test. <br />
