<br />r; 'f--t+ I rj{ 1 <br /> <br />\..\ C I( <br /> <br />OPBRATING AGRBBIIBlft' <br />BBTWBBR <br />LOWER COLORADO RIVER AO'l'BORI'l'Y <br />AND <br />THB CI'l'Y 01' SAN MARCOS, TBXAS <br /> <br />This Agreement between LOWER COLORADO RIVER AUTHORITY <br /> <br />(hereinafter WLCRAW), a public corporation created and existing <br />under and by virtue of the laws of the State of Texas with its <br /> <br />principal office at Austin in Travis County, Texas, and THE <br />CITY OF SAN MARCOS (hereinafter "CITY"), a municipality organ- <br /> <br />ized and existing under the laws of the State of Texas, located <br /> <br />in Hays County, Texas. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, LCRA is the owner and operator of dams, <br /> <br />hydro-electric plants, power stations, transmission lines and <br />distribution facilities and is.engaged in the generation, <br /> <br />transmission, distribution and sale of electric power and <br /> <br />energy in the area certificated to LCRA by the Texas Public <br /> <br />Utility Commission in which CITY is located; and <br /> <br />WHEREAS, under an Amendment to Memorandum of <br /> <br />Understanding dated June 6, 1986, LCRA has agreed to sell and <br />convey to the CITY and the CITY has agreed to purchase all of <br /> <br />-1- <br />
