<br /> <br />0 <br /> <br /> <br />12 <br /> <br />ORDINA~CE 1986-136 <br /> <br />1"(\ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALING ORDINANCE NO. 1985-94 WHICH <br />GRANTED A CONDITIONAL PERMIT FOR THE SUNRIDGE PLANNED <br />UNIT DEVELOPMENT DISTRICT AND INCORPORATED THE PLANNED <br />UNIT DEVELOPMENT PLAN FOR THE SUNRIDGE PLANNED UNIT <br />DEVELOPMENT DISTRICT AS PART OF THE OFFICIAL ZONING MAP <br />OF THE CITY OF SAN MARCOS; ADOPTING AN ORDINANCE OF THE <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE GRANTING OF A NEW PERMIT BY THE PLANNING <br />COMMISSION FOR A PLANNED UNIT DEVELOPMENT DISTRICT ON A <br />26.468 ACRE TRACT OF LAND OUT OF THE E. CLARK SURVEY <br />#11, AND THE R.H. WILLIAMS SURVEY #12, HAYS COUNTY, <br />TEXAS, LOCATED ON BISHOP APPROXIMATELY 300 FEET SOUTH <br />OF RANCH ROAD 12; APPROVING A REVISED PLANNED UNIT <br />DEVELOPMENT PLAN FOR SAID 26.468 ACRE TRACT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on September 23, 1985, the City Council approved the <br />granting of a conditional permit for the Sunridge Planned Unit <br />Development District on a 26.468 acre tract of land out of the E. Clark <br />Survey #11, and the R.H. Williams Survey #12, Hays County, Texas, <br />located on Bishop approximately 300 feet south of Ranch Road 12; and, <br /> <br />WHEREAS, the proponents of said Sunridge Development District <br />Planned Unit desire to revise the Planned Unit Development Plan from <br />"PUD" (Duplex) to "PUD" (Single Family Residential); and, <br /> <br />WHEREAS, Section F(2), Article <br />of the Code of Ordinances of the <br />Planning Commission of the City <br />planned unit developments subject to <br />Counc i 1; and, <br /> <br />V, Subdivision Ordinance Appendix C <br />City of San Marcos empowers the <br />of San Marcos to grant permits for <br />review and approval by the City <br /> <br />WHEREAS, on July 29,1986, the Planning Commission of said City <br />approved the granting of a new permit for the Sunridge Planned Unit <br />Development District on said 26.468 acre tract of land out of the E. <br />Clark Survey #11, and the R.H. Williams Survey #12; and, <br /> <br />WHEREAS Section 34(C), General Zoning Ordinance, Appendix A of <br />the Code of Ordinances of the City of San Marcos requires approval by <br />the Zoning Commission of the City of San Marcos of a Planned Unit <br />Development Plan; and, <br /> <br />WHEREAS, on August 5, 1986, said Zoning Commission approved a <br />Final Planned Unit Development Plan for said 26.468 acre tract of land <br />revised from "PUD" (Duplex) to "PUD" (Single Ramily Residential); and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY <br />TEXAS: <br /> <br />COUNCI L OF <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />SECTION 1. That Ordinance 1985-94 adopted September 23,1985, <br />which granted a conditional permit for the Sunridge Planned Unit <br />Development District and incorporated the Sunridge Planned Unit <br />Development Plan as part of the official zoning map of the City of San <br />Marcos is hereby repealed. <br /> <br />SECTION 2. That said Planning Commission's grant of a revised <br />permit for a Planned Unit Development District of said 26.468 acre <br />tract of land out of the E. Clark Survey #11, and the R.H. Williams <br />Survey #12; more particularly described by metes and bounds in Exhibit <br />"A" which is attached hereto and incorporated herein for all purposes <br />is hereby approved. <br /> <br />SECTION 3. That the Zoning Commission approval of a Final Planned <br />Unit Development Plan for said 26.468 acre tract of land revised from <br />"PUD" (Duplex) to "PUD" (Single Family Residential) which is attached <br />hereto and incorporated herein for all purposes as Exhibit "B", is <br />hereby approved. <br />
