0 12 ORDINA~CE 1986-136 1"(\ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REPEALING ORDINANCE NO. 1985-94 WHICH GRANTED A CONDITIONAL PERMIT FOR THE SUNRIDGE PLANNED UNIT DEVELOPMENT DISTRICT AND INCORPORATED THE PLANNED UNIT DEVELOPMENT PLAN FOR THE SUNRIDGE PLANNED UNIT DEVELOPMENT DISTRICT AS PART OF THE OFFICIAL ZONING MAP OF THE CITY OF SAN MARCOS; ADOPTING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE GRANTING OF A NEW PERMIT BY THE PLANNING COMMISSION FOR A PLANNED UNIT DEVELOPMENT DISTRICT ON A 26.468 ACRE TRACT OF LAND OUT OF THE E. CLARK SURVEY #11, AND THE R.H. WILLIAMS SURVEY #12, HAYS COUNTY, TEXAS, LOCATED ON BISHOP APPROXIMATELY 300 FEET SOUTH OF RANCH ROAD 12; APPROVING A REVISED PLANNED UNIT DEVELOPMENT PLAN FOR SAID 26.468 ACRE TRACT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on September 23, 1985, the City Council approved the granting of a conditional permit for the Sunridge Planned Unit Development District on a 26.468 acre tract of land out of the E. Clark Survey #11, and the R.H. Williams Survey #12, Hays County, Texas, located on Bishop approximately 300 feet south of Ranch Road 12; and, WHEREAS, the proponents of said Sunridge Development District Planned Unit desire to revise the Planned Unit Development Plan from "PUD" (Duplex) to "PUD" (Single Family Residential); and, WHEREAS, Section F(2), Article of the Code of Ordinances of the Planning Commission of the City planned unit developments subject to Counc i 1; and, V, Subdivision Ordinance Appendix C City of San Marcos empowers the of San Marcos to grant permits for review and approval by the City WHEREAS, on July 29,1986, the Planning Commission of said City approved the granting of a new permit for the Sunridge Planned Unit Development District on said 26.468 acre tract of land out of the E. Clark Survey #11, and the R.H. Williams Survey #12; and, WHEREAS Section 34(C), General Zoning Ordinance, Appendix A of the Code of Ordinances of the City of San Marcos requires approval by the Zoning Commission of the City of San Marcos of a Planned Unit Development Plan; and, WHEREAS, on August 5, 1986, said Zoning Commission approved a Final Planned Unit Development Plan for said 26.468 acre tract of land revised from "PUD" (Duplex) to "PUD" (Single Ramily Residential); and, WHEREAS, said City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety; now, therefore, BE IT ORDAINED BY THE CITY TEXAS: COUNCI L OF THE CITY OF SAN MARCOS, SECTION 1. That Ordinance 1985-94 adopted September 23,1985, which granted a conditional permit for the Sunridge Planned Unit Development District and incorporated the Sunridge Planned Unit Development Plan as part of the official zoning map of the City of San Marcos is hereby repealed. SECTION 2. That said Planning Commission's grant of a revised permit for a Planned Unit Development District of said 26.468 acre tract of land out of the E. Clark Survey #11, and the R.H. Williams Survey #12; more particularly described by metes and bounds in Exhibit "A" which is attached hereto and incorporated herein for all purposes is hereby approved. SECTION 3. That the Zoning Commission approval of a Final Planned Unit Development Plan for said 26.468 acre tract of land revised from "PUD" (Duplex) to "PUD" (Single Family Residential) which is attached hereto and incorporated herein for all purposes as Exhibit "B", is hereby approved.
