PROPOSITION NO. 25 <br />The amendment of Sections 6.10. 7.01(b) and 10.02 of the City Charter to correct <br />spelling, grammatical, and typographical errors. <br />FOR 1,984 <br />AGAINST 121 <br />SECTION 4. That Lisa Prewitt received a majority of the votes and is elected to serve as <br />City Council Member Place 1. <br />SECTION 5. That Jude Prather received a majority of votes and is elected to serve as <br />City Council Member Place 2. <br />SECTION 6. Proposition 1, to allow the city council to appoint two planning and zoning <br />commissioners who do not own real property in the city at the time of appointment, did not <br />receive a majority of votes cast and that proposed amendment is not adopted. <br />SECTION 7. Proposition 9, to increase the residency requirement from one year to three <br />years for city council candidates, received a majority of votes cast but that proposed amendment <br />is not adopted because it would conflict with Section 141.003 (b) of the Texas Election Code <br />which prohibits home rule charters from prescribing a minimum length of residence requirement <br />longer than 12 months. The one year residency requirement for city council candidates in <br />Section 3.02(a)(2) of the city charter shall, therefore, remain in effect. <br />SECTION 8. Propositions 2, 3, 4, 5, 6, 7, 8, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, <br />219 22, 24, and 25 are hereby adopted and the San Marcos City Charter is hereby amended as of <br />the effective date of this ordinance to incorporate the text amendments corresponding to each of <br />those propositions as set forth in Ordinance No. 2013 -44 that called the special charter <br />amendment election. <br />SECTION 10. The importance of this ordinance creates an emergency and an imperative <br />public necessity, and the provisions of the charter requiring that ordinances be presented at two <br />separate meetings be waived and, this ordinance will take effect upon its adoption. <br />PASSED, APPROVED AND ADOPTED this the 18th day of November 2013. <br />13 <br />
