<br />C. Contractor shall submit to Department a copy of its executed loan <br />agreement or contract with the private firm involved in the project funded <br />under this contract prior to Department1s release of project funds for such <br />project. Such document must detail the loan terms and conditions, including <br />the following: (l) the loan amount and interest rate; {2} the amortization <br />schedule; (3) the repayment schedule, including the date that the loan <br />repayments from the firm to Contractor will begin; (4) Contractor's <br />security/lien position on the loan; (5) the details of the loan servicing <br />provisions, i.e., who will oversee it; (6) the types of positions, number, and <br />wage scales of all permanent positions to be created/retained as a result of <br />this project, including specifics on those jobs filled/to be filled by <br />10w-and-moderate-income persons; (7) a hiring plan that includes methods of <br />identifying and training potential low/moderate income job applicants; and (8) <br />any other relevant details or special conditions placed on the loan. <br /> <br />D. Contractor shall submit to Department documentation of Ember Industries, <br />Inc.'s executed loan agreement of Two Hundred Thousand and no/100 Dollars <br />($200,000.00) from Hays County National Bank in San Marcos and guaranteed by <br />the U.S. Small Business Administration to be utilized in conjunction with the <br />project funded under this contract prior to Department's release of project <br />funds for such project. <br /> <br />E. Contractor shall submit to Department documentation of Ember Industries, <br />lnc.ls equity injection of Sixty Thousand and no/100 Dollars ($60,000.00) <br />prior to Department's release of project funds. This injection shall be in <br />the form of cash. <br /> <br />SECTION 23. <br /> <br />ORAL AND WRITTEN AGREEMENTS <br /> <br />A. All oral and written agreements between the parties to this contract <br />relating to the subject matter of this contract that were made prior to the <br />execution of this contract have been reduced to writing and are contained in <br />thi s contract. <br /> <br />B.
