<br />2. <br /> <br />-2- <br /> <br />Ember agrees to: <br /> <br />A. <br /> <br />$90,000 of loan funds for machinery and equipment <br />$37,000 of loan funds for working capital. <br /> <br />Use <br />and <br /> <br />B. <br /> <br />$60,000 <br /> <br />corporate <br /> <br />Use <br /> <br />of <br /> <br />funds <br /> <br />for working capital. <br /> <br />C. <br /> <br />Provide to the City documentation of its executed loan <br />agreement with the Hays County National Bank in San <br />Marcos guaranteed by the u.s. Small Business <br />Administration in the amount of $200,000 to be used for <br />equipment purchases. <br /> <br />D. <br /> <br />Begin semi-annual repayments in the amount of <br />$17,712.35 to the City beginning November 12, 1987, <br />with the last installment due on November 12,1991. <br /> <br />E. <br /> <br />Hire an additional forty (40) employees in <br />positions, as a result of this project, <br /> <br />permanent <br /> <br />F. <br /> <br />Target all forty (40) new jobs to low and moderate <br />income persons. This shall be done by utilizing the <br />following hiring procedures: <br /> <br />1. Screening of employment applications as well as <br />interviewing clients referred to the Firm by the <br />Texas Employment Commission's Local Office. <br /> <br />2. <br /> <br />Exploring the availability and use of local Job <br />Training Partnership Act funds for private-sector <br />job training activities. <br /> <br />3. <br /> <br />Using local Job Training Partnership Act clients for <br />jobs when such clients are available. <br /> <br />4. <br /> <br />Following all non-discrimination and equal <br />employment opportunity provisions of state and <br />federal law. <br /> <br />G. <br /> <br />Furnish to the City, to be filed with the Hays County <br />Clerk and with the Secretary of State Texas, Uniform <br />Commercial Code security agreements giving the City <br />first liens on machinery and equipment purchased with <br />the $90,000 in Texas Development Community Affairs <br />loan funds. <br /> <br />H. <br /> <br />Furnish to the City, to be filed with the Hays County <br />Clerk and with the Secretary of State Texas Uniform <br />Commercial Code security agreements giving the City <br />second liens on machinery and equipment purchased with <br />the $200,000 in SBA loan funds. <br /> <br />I. <br /> <br />Present any and all documentation (e.g., receipts, <br />purchase orders, et.al.) to the City prior to cash <br />drawdown by the City of TDCA Contract funds, in order to <br />
