Hankins * <br />City Attorney <br /> <br />Published in the San Marcos DAILY RECORD November 30, 1986 <br /> <br />*Pursuant to the requirements of Section 3.11 of the Charter of the City <br />of San Marcos which provides that "the City Attorney shall approve all <br />ordinances adopted by the Council, as to the legality thereof, or shall <br />file with the City Secretary written legal objections thereto," I <br />herewith file the following legal objection to the adoption of the <br />foregoing ordinance on emergency. <br /> <br />The San Marcos City Charter, Section 3.11, provides that an ordinance <br />may be adopted on emergency where such ordinance relates "to the <br />immediate preservation of the public peace, health, or safety." This <br />provision allows an ordinance to be passed on emergency where there is <br />some public benefit or necessity for such emergency passage that <br />relates to the public peace, health or safety. In regard to the <br />foregoing ordinance, I am unable to discern any public benefit or <br />necessity relating to the public peace, health or safety that woul( <br />permit emergency passage.
