That the importance of this Ordinance creat.es an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance Shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. Hankins * City Attorney Published in the San Marcos DAILY RECORD November 30, 1986 *Pursuant to the requirements of Section 3.11 of the Charter of the City of San Marcos which provides that "the City Attorney shall approve all ordinances adopted by the Council, as to the legality thereof, or shall file with the City Secretary written legal objections thereto," I herewith file the following legal objection to the adoption of the foregoing ordinance on emergency. The San Marcos City Charter, Section 3.11, provides that an ordinance may be adopted on emergency where such ordinance relates "to the immediate preservation of the public peace, health, or safety." This provision allows an ordinance to be passed on emergency where there is some public benefit or necessity for such emergency passage that relates to the public peace, health or safety. In regard to the foregoing ordinance, I am unable to discern any public benefit or necessity relating to the public peace, health or safety that woul( permit emergency passage.
