<br />If necessary, the Engineer shall implement <br /> <br />construction <br /> <br />costs <br /> <br />savings <br /> <br />measures <br /> <br />or <br /> <br />otherwise <br /> <br />endeavor to limit probable construction <br /> <br />cost to the level of available funds set by the OWner. <br /> <br />Am'ICLE 4 <br /> <br />REIMBURSABLE EXPENSES <br /> <br />4.1 <br /> <br />If reimbursable expenses are to be <br /> <br />paid <br /> <br />as <br /> <br />a <br /> <br />part <br /> <br />of <br /> <br />this <br /> <br />1\greement <br /> <br />as <br /> <br />set forth in Article 13, such expenses are in <br /> <br />addition to <br /> <br />:he Compensation for Basic and Additional Services <br /> <br />and <br /> <br />include <br /> <br />certain <br /> <br />actual expenditures made by the Engineer and the Engineer's employees and <br /> <br />consultants in the interest of the Project for the expenses listed in the <br /> <br />following Subparagraph: <br />4.1.1 Long distance telephone calls, advertisements for bids, <br /> <br />copying expenses other than that provided as a part of Basic Services, <br /> <br />reasonable travel expenses outside the City of San Marcos, Texas, <br /> <br />expenses for subsistence outside the City of San Marcos, Texas, as <br /> <br />approved by Owner. <br /> <br />ARTICLE 5 <br /> <br />PAYMENTS TO THE ENGIBEER <br /> <br />5.1 <br /> <br />PAYMENTS ON ACCOUNT OF BASIC SERVICES <br /> <br />5.1.1 <br /> <br />Payments <br /> <br />for <br /> <br />Basic Services shall be made to Engineer monthly <br /> <br />:ollowing receipt by Owner of Engineer's invoice therefor and shall be in <br /> <br />proportion <br /> <br />to <br /> <br />services <br /> <br />performed <br /> <br />so <br /> <br />that <br /> <br />the <br /> <br />compensation <br /> <br />at <br /> <br />the <br /> <br />completion <br /> <br />of <br /> <br />each <br /> <br />of <br /> <br />the <br /> <br />phases <br /> <br />shall be on the basis set forth in <br /> <br />Article 13, less any disputed amounts, pending resolution theceof. <br /> <br />5.1.2 <br /> <br />When compensation is based <br /> <br />on <br /> <br />a <br /> <br />percentage <br /> <br />oc <br /> <br />Construction <br /> <br />Cost, <br /> <br />and <br /> <br />any <br /> <br />portions <br /> <br />of <br /> <br />the <br /> <br />Project <br /> <br />are .le leted or otherwise not <br /> <br />constructed, compensation for sl1ch <br /> <br />portions <br /> <br />of <br /> <br />the <br /> <br />Project <br /> <br />shall <br /> <br />be <br /> <br />payable <br /> <br />to <br /> <br />the <br /> <br />extent <br /> <br />services <br /> <br />are <br /> <br />performed <br /> <br />on <br /> <br />such portions, in <br /> <br />accordance with the schedule set forth in Subparagraph 13.1.2, <br /> <br />based <br /> <br />on <br /> <br />( 1) <br /> <br />the <br /> <br />lowest <br /> <br />bona fide bid or negotiated proposal or, (2) if no such <br /> <br />bid or proposal is received, the most recent detailed cost <br /> <br />estimate <br /> <br />(if <br /> <br />approved by OWner) for such portions of the Project. <br /> <br />).2 <br /> <br />PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES <br /> <br />5.2.1 <br /> <br />Payments <br /> <br />on <br /> <br />account <br /> <br />of the Engineer's Additional Services as <br /> <br />lefined in Paragraph 1.6 and for <br /> <br />Reimbursable <br /> <br />Expenses <br /> <br />as <br /> <br />defined <br /> <br />in <br /> <br />Article <br /> <br />4 <br /> <br />shall <br /> <br />be <br /> <br />made <br /> <br />monthly <br /> <br />upon presentation of the Engineer's <br /> <br />statement of services rendered or expenses incurred, <br /> <br />less <br /> <br />any <br /> <br />disputed <br /> <br />amounts, pending resolution thereof. <br /> <br />-12- <br />
