<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, N4ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOT 3, BLOCK 1 OF THE PECAN CREEK ADDITION SECTION
<br />TWO, SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME
<br />3, PAGE 52 OF THE HAYS COUNTY PLAT RECORDS; A/K/A 415 WEST
<br />SAN ANTONIO STREET FROM "c" (COMMERCIAL DISTRICT) TO "MF-4"
<br />(MULTI-FM1ILY DISTRICT); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on
<br />of San Marcos held
<br />the zoning
<br />(Multi-Family District)
<br />Section Two, San Marcos,
<br />
<br />October 21,1986, the Zoning Commission of the City
<br />a public hearing regarding a request to change
<br />from "C" (Commercial District) to "MF-411
<br />of Lot 3, Block 1 of the Pecan Creek Addition
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on October 21,1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of December, 1986, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />
<br />SAN

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"c" (Commercial District) be rezoned "MF-4" (Multi-family District):
<br />
<br />LOT 3, BLOCK 1 OF THE PECAN CREEK ADDITION SECTION TWO, SAN
<br />MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 3, PAGE 52 OF
<br />THE HAYS COUNTY PLAT RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on January 12, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this the 15 day of December, 1986 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for January 12, 1987
